Would-be Kinect Indie Game developers out there should prepare for some bad news. Speaking to Digital Spy, a Microsoft spokesman stated that currently "only developers with established contracts with Microsoft" are allowed to develop projects for Kinect. Only those developers that Microsoft has "partnered with for the launch" will release Kinect games at first.
That's not to say that budding XNA developers will never get their hands on the Kinect. The spokesman acknowledged that Microsoft would "consider" the possibility for the future, though he added that "no plans can be confirmed at this time."
Here's hoping Indie devs get Kinect support sooner rather than later. The creative possibilities are definitely there and, besides, where else would we get Kinect-enabled fart simulators now that support for Fable 3 has been delayed?

Any lag you might see when using Kinect is the result of software and programming choices, not a limitation in the hardware itself.
That's according to the Chief Technology Officer at Blitz Games Andrew Oliver, who says that, as with a new console, it's just a matter of time before developers get to grips with Kinect and guarentee lag-free gaming.
"There are various technologies involved. Some people are using a skeletal system, and it takes a little bit of time to calculate. It's only a split second," Oliver explained.
"We're actually using a different masking system, which can tighten things up."
"I have seen a few games with a bit of lag, but that is the software choice of the creators," he continued.
"They've programmed it a certain way, and they'll come up with new techniques. There doesn't need to be a lag. We can get it down to maybe two frames behind, which is pretty insignificant; you won't notice. We're just learning new tricks. Ours is pretty tight."
In the same way that developers are constantly learning how to squeeze a little bit more juice out of the PS3 and 360, then Oliver reckons that the first wave of Kinect software "will look like nothing compared to second and third generation."
Kinect lag seems to be becoming less and less of an issue already. Our own Tim Ingham had some dance time with the motion control and found it to be "frighteningly accurate and shockingly responsive".

After years (and years) of waiting it's no surprise to see the Xbox 360 finally sliding into the role of IPTV set-top box, but we couldn't have seen Canada's Telus being the first in North America to offer the option. It only switched customers over to the Microsoft Mediaroom platform (also used by AT&T's U-Verse, where the feature should appear soon) powering its Optik TV package earlier this year, enabling this new multiroom setup. Of course, that means the Xbox 360 can't be the only set-top box in the house -- it just acts as a client to the main DVR for live TV watching, or to schedule and watch previously recorded programming. Subscribers owners can check the main website for access on their current Xbox 360 or grab a free new system by signing up for two years of internet access. Mediaroom 2.0 is expected to bring PCs and mobile devices into the fold at some point as well, but for now check out the Xbox 360 experience in our video demo after the break, as well as a press release with all the details.

The developer drafted in by Konami to work on the upcoming Castlevania: Lords of Shadows has said that while the game will be shipping on a single Blu-ray disc for PS3, the Xbox 360 SKU will have to be put onto two DVDs.
Furthermore, it thinks that the problem is only going to worsen for Microsoft.
“Microsoft actually sent their tech guys to the studio to see the game and look at how we're compressing it, but they said it’s OK, we're doing all we can,” Mercury Steam boss Dave Cox told Xbox World 360, as reported by CVG.
“I think it's something Microsoft are going to experience more and more – that they need to help developers overcome the storage problem. I mean, each console has it's own issues, but you have to work around them.”
And despite that fact that famed Metal Gear Solid developer Hideo Kojima has been drafted in to work on the games, Cox insists that it isn’t the length of cut-scenes that is to blame. Instead, the title’s 24 hour story mode has been pegged as the main culprit.
Of course, now that Xbox 360 is able to install games onto HDD any potential inconvenience that will be occurred is dramatically lessened for those with enough storage left on their machines. Indeed, Cox stated that when installed the game will be playable form only the second disc.

Playing Xbox games online is no longer under threat – if it ever was - following Microsoft's victory in a legal battle over multiplayer gaming.
A US district court judge chucked a case out against Microsoft that claimed the US console manufacturer infringed a patent for multiplayer gaming, Gamasutra reports.
In 1994, when dinosaurs roamed the earth, Harold Milton Jr. filed the patent 'Apparatus and method for electrically connecting remotely located videogames'.
He called it a system "for two or more players playing the same video game to compete with each other without using the same physical video game which alleviates the necessity of proximity of the players". Forward-thinking bloke, that Milton.
In 2004, after the dinosaurs had been made extinct, Milton filed suit against Microsoft and Sony, accusing the console manufacturers of infringing on the patent with Xbox Live and PlayStation Network, and sought royalties and an injunction against their continued use.
Sony settled out of court with Milton last April, but Microsoft stood firm.
Last week, the judge made it all worthwhile when he ordered Milton to pay Microsoft's legal fees. Bet that'll burn a hole in his wallet.
The judge didn't like the term "electrical connection", and decided Xbox Live uses nothing of the sort.

The Xbox Live Arcade port of Plants vs. Zombies has been given a (re-)birthday: Wednesday, September 8. In just five weeks, Xbox gamers who haven't already picked up PopCap's polished tower defense game on PC, Mac or iPhone/iPad can do so on XBLA for $15 (or 1200 Xbox bucks). This latest version doesn't only bring an HD, controller-optimized experience to the console space, it also adds two new multiplayer modes: Co-op and Versus.
In IGN's brief writeup of the game, the site says one co-op strategy is to have one player use defensive plants while the other uses offensive plants, as they try to hold back the oncoming undead. In Versus mode, the zombie player has to eat his or her way into the plant player's home, while the plant player has to shoot down three zombie targets. If the multiplayer enhancements in PopCap's XBLA port of Peggle are any indication, you should expect more than just bullet-point upgrades.

2011 racer DiRT 3 will have over 50 rally cars, Codemasters has confirmed.
They will represent "the very best from five decades of the sport".
DiRT 3, officially confirmed with the release of a trailer over the weekend, has more than double the track content of 2009's DiRT 2.
Players will begin the new career mode at the top as a professional driver, with a top-flight career in competitive off-road racing "complimented by the opportunity to express themselves in Gymkhana-style showpiece driving events".
Supplimenting the traditional rally driving will be performance driving showcases and career challenges "where car control is pushed to spectacular limits".
Codies describes DiRT 3 as "the biggest, content-rich racer ever to roar out of Codemasters Studios".
In Edge magazine chief game designer Matt Horsman called it "the biggest rally game ever made".
DiRT 3 is due out on the PC, PlayStation 3 and Xbox 360 next year.

Motion control devices like Kinect will not cause the death of the traditional controller, insists Microsoft Games Studios Europe creative director, Peter Molyneux.
Speaking in a recent interview, the Lionhead man argues that game controllers are "not going anywhere" and that motion control is simply "a different kind of experience".
"The controller is a skateboard," he told Develop. "It requires an element of skill and practice for use. And yes, it is lovely and refreshing to use motion controllers, but they are a different kind of experience.
"You can argue all you want that bicycles are better for cycling than skateboards, but ultimately they're too different experiences for compare.
"Games controllers have been designed for two decades, and they're not going anywhere, they will continue to evolve," he added. "I don't think motion control, in itself, will cause the death of standard controllers."
Molyneux - who's overseeing big first-party Kinect games like Milo & Kate and Kinect Sports - says the device has been "a really interesting concept" over the last few years - though he's not sure it's been the most important change in gaming.
"That would be a difficult one to choose - handheld gaming, social gaming, the cloud, online gameplay," he said.
"It's been an amazing ride these last five years. I don't think anyone's stopped to notice that every six months over the last five years something's happened that's changed the course of the industry."
Lionhead's latest, Fable III, is just starting to gear up for release.

The independent developer formation “4kids games” has released their initial title on PC and Xbox LIVE Indie Games. Ancient Trader is a simple, easy entry strategy game suitable for all ages, which originally came to life as a board-game design.
The game takes you and up to 4 players on a journey of discovery in uncharted oceans, with wealthy ports awaiting discovery and mythical sea monsters roaming the waters, hunting for prey. Your goal in the game is to discover new opportunities for trade, upgrade your ship and weapons and challenge the monsters and competing traders in simple battles with stylized card-minigames.
You can play on 9 pre-defined maps on three different difficulties or create random new maps with different parameters and set-up conditions for your single- or multiplayer games. Besides its easy-to-learn, pick-up and play strategic tabletop appeal, the main attraction of Ancient Trader is the beautiful and distinctive visual presentation of the game. The whole artwork of the game is hand-crafted, stylized to resemble the copper-stitch style of old maps and pictures from the late middle-ages. The players are immersed into the atmosphere of great expeditions into the unknown seas and back to times when the empty spots on the maps were believed to be inhabited by mystical monsters and ancient guardians.
Peter Levius, the author of the original concept comments:
“My vision was to create a minimalistic strategy game that would have a complex winning strategy and beautiful old map visuals. I am happy to see that many people like the result.”
Petr Vcelka, responsible Artist:
“When I finish a project, I usually don’t want to see it anymore. But Ancient Trader is an exception. When I play it, I forget that I actually worked on it.”
Ancient Trader is available on Xbox LIVE Indie Games and also on PC via digital distribution sites like Gamersgate, Youdagames or Gamesload.
The game was already well received by the press and will also next be featured in actual Indie Game competitions.

After building anticipation for two weeks, redspotgames and Z-Software disclose the final details of Solar Struggle. The game will be released for the Xbox Live Indie Games platform and will be available in August 2010. The price will be only 400 Microsoft Points.
As mentioned in the press release two weeks ago, Solar Struggle will set new quality standards on the platform and explore far-ranging possibilities. "This announcement hasn't been just empty promises," says Z-Software's CEO Andreas Heldt, "for example, the graphical details will be much higher than most Xbox Live Indie Games. Also, you won't find as powerful a 3D engine among other Indie Games. The story is well thought out, includes plot twists and will be filled with cut scenes and voices from famous voice actors." David Michael Williamson, star of the English version, has made a name for himself as screenwriter and actor in movies like 'Over My Dead Body'. Voice talents like Willi Röbke, well-known as the German voice for characters in TV series like 'The Simpsons', 'Futurama', and 'The Super Mario Bros. Super Show' as been hired as well, as have many other talented actors.
Max Scharl, CEO of redspotgames, adds: "Within the last few years there has been a rise in quality among the games of Xbox Live Arcade. We're trying something similar with Solar Struggle for Xbox Live Arcade. We're going to test how a highquality title will be received on this network and see whether it opens up new possibilities." Not long ago a game like Solar Struggle would have been released as a Arcade Game and not among the Indie Games. The Munich-based publisher redspotgames also contributed to this production with voice recordings and other support. The game has been in development since the end of 2008 and has had the largest budget of all known Xbox Live Indie Games.
The player can get into the act with three different factions: The Consortium, the Outlaws and the Military. There are 9 different ships available which can be upgraded and expanded in any order through achievements from 11 missions. Among them are the ship classes Count, Interceptor and Bomber. Beside them there will be Destroyers and Battleships in the game who need to be protected or destroyed.
