The trial in Marshall, Texas, centers on technology for ways to control interactive applications over multiple computers. MPath was "a pioneer in the online video industry in the area of real-time, multiplayer online games," PalTalk lawyer Max Tribble told the jury.
Microsoft said it did review the MPath inventions and chose a different path in developing its games. The technology is for an older dial-up method of communicating between computers, and "the patents don't cover the way the 'Halo' games work," Pritikin said.
"Microsoft decided to go in another direction and work with another company," he told the jury. "Obviously, this was upsetting to PalTalk and its employees."
Microsoft also is challenging the validity of the PalTalk patents and told the jury that, even if it agrees with PalTalk, "the patents aren't worth much, certainly not $90 million."

Project Gotham Racing 4's Premium Challenge Pack is the new Xbox Live Deal of the Week.
The pack, which includes more than ten new vehicles and the World Challenge Arcade Mode, is now available for 240 Microsoft points (£2.04), a saving of 40% from its original 400 point price tag.
The deal's available only to Xbox Live Gold members, says Microsoft, and it's trying to make sure that XBL deals are available to all regions.
Forthcoming Xbox Live deals include a discount (between 25% and 50% apparently) on the original Xbox version of Fable, which will be nice.

he Fifth Estate, a Canadian investigative reporting program that's been on the air for over three decades, recently ran a piece looking into the untimely death of gaming enthusiast Brandon Crisp, who ran away from his Ontario home last October after his parents took away his Xbox 360, and was found dead three weeks later due to injuries sustained from falling out of a tree. Within the first few minutes of the short documentary, titled "Top Gun," The Fifth Estate's angle on the piece becomes clear: Some entity or cultural force is to blame for Crisp's death, and it's going to find out what it is.
It settles at first on Crisp's infatuation with Call of Duty 4: Modern Warfare, which is strengthened by his active participation on the MLG-owned clan-ranking site GameBattles.com. From there, it delves into the foul underworld of competitive gaming, showing how attaching cash rewards to intense, lengthy sessions with mature video games is creating an irresistibly attractive lifestyle for those who fall beneath such titles' age restrictions. All the while, it depicts the unimaginable violence present in said games, and explain the detrimental effects it has on the lives of otherwise normal youths.
We lay this outline of the 40-minute documentary before you so that you don't actually have to watch it, as the sensationalism it contains and factual liberties it takes will likely raise the gaming community's collective hackles to unprecedented levels.

A story posted on the Ubergizmo site today states, "Word on the street has it that Microsoft aims to stop production of the Xbox 360 Elite as per their original plan..."
The story appears to derive from Fudzilla, then via Joystiq. The Fudzilla story - by David Stellmack, says, "Microsoft will stop taking orders for the Xbox 360 Elite at some point during the second quarter and allow inventory of the Elite consoles to start to run down. The majority of retailers would prefer just a low-end and a high-end console, so this change will be made during the second quarter, which is the fourth fiscal quarter for Microsoft.
"Once inventory is depleted, the Elite system will move to more of a limited edition role that will be available only at select retailers, and likely only in North America and Europe. The Elite consoles that will be available in these areas sbould be more like the recent Resident Evil 5 Red Elite Limited Edition console, rather than the standard Elite package that Microsoft has offered in the past."
We contacted Microsoft in the UK today and were told, "We don't comment on rumour or speculation".

Crystal Defenders R1 and R2 are live downloads on WiiWare in Japan. We’ve been following both releases expecting a North American launch any Monday now. Instead the Tose programmed Xbox Live Arcade version comes out in North America first. We get it on Wednesday.
Unlike the WiiWare Crystal Defenders series this is a direct conversion Crystal Defenders for the iPhone. You get 300 stages of Final Fantasy Tactics A2 tower defense for 800 Microsoft Points ($10). That sure beats paying the $10 for 100 stages on WiiWare! You can purchase Crystal Defenders and Peggle, this week’s other Xbox Live Arcade release also on sale for 800 Microsoft Points, for the same price as all the current Crystal Defenders content on WiiWare.

Rare is planning on lifting the lid off an expansion for Banjo Kazooie: Nuts & Bolts, potential downloadable content it hopes to announce sometime this week. That announcement may even herald a new promotional logo!
That last part probably isn't all that exciting, except to sales and marketing types, but Rare's Lord of Games, the fictional creator of Banjo Kazooie: Nuts & Bolts's game worlds, has something up his sleeve(s). The only hint LOG gives is that something new will be arriving due to "popular demand."

It's a triple play this week on Xbox Live Arcade, the addictive gameplay of Peggle, the strategic defense of Crystal Defenders, and new downloadable content for Twisted Pixel's The Maw.
Peggle is the tremendously addictive ball-bouncing game for the PC, ported to Xbox Live Arcade with 55 levels, 75 challenges, and multiplayer support via Xbox Live for 2-4 players. I am terrified to purchase it, since the last time I launched Peggle on Steam I disappeared for several days.
Crystal Defenders is Square's take on tower defense, using characters from the Final Fantasy Tactics series to defend your crystals against evil invading hordes of classic Final Fantasy monsters in more than 300 increasingly difficult stages.
Rounding up this week's Arcade releases is the second downloadable level for Twisted Pixel's The Maw, River Redirect, delivering a little more gameplay for a little more money.
Both Peggle and Crystal Defenders will run you 800 Microsoft points, with The Maw: River Redirect a steal at 160 points.

As pumped as we are at the prospect of a current-gen rendition of Sega's Outrun series, it's tough to judge the aesthetics of racing games without seeing them in action. Thankfully, some gameplay footage of the XBLA (and European PSN) racer OutRun Online Arcade recently surfaced in a YouTube video (which we've courteously posted after the jump).
It looks about as fun and arcade-y as you'd expect -- realistic physics are suspended in favor of endless drifting, and cars travel at sound barrier-breaking velocities. Also making a reappearance is the series' blonde passenger, who helpfully squaks asinine remarks (such as, "I want to go far away!") as you maneuver through hairpin turns going 280 km/h. Thanks for contributing, you fair-haired freeloader.

Having received a few reports on the CK3 Pro burning out for some users we did some major investigating and here are our results:
First of all, there seems to be 2 problems that are happenning, one is the 5V trace burnt out, the other one is PL-2303 becoming hot / failing, and here are our findings:
1. 5V trace burnt out: This certainly happens with users plugging the power cable in the wrong way, if you plugged power cable up-side down, then the 5V power was connected to Ground directly and burnt out the trace when turning on the switch, that's why users always say the 5V trace burned out, but never said that 12V/3.3V trace was burned out, and every piece of CK3 Pro/Lite tested in the factory with PC USB detected test and power output tooling test before they ship out, so it's the ONLY reason to burn out the 5V trace -> the Power Cable was plugged up-side down, anyway, we are now making CK3 with PPTC protection as reported earlier, so this should solve that issue problem.
2. PL-2303 (CK3 PRO IC) became hot: A few users post about they found the PL Chip getting hot by plugging the USB cable only; we thought the PL chip was burning out for an unknown reason as we couldn't reproduce (for your information, the PL chip gets power from USB port only, it doesn't get any power connected to the CK3 Pro, and there are only 2 data traces connected between PL chip and CK3 Pro, no more!) So we have discovered that it is damaged from the input power of the PL chip, which it gets from the USB port, and if the USB port supports 5V power which is not stable or if another USB cable is used that is poor quality, then it might let the PL chip work with not reliable 5V power, then it may become damaged. We will change the layout to add more protection components on the power circuit of PL chip to compensate for unstable USB 5v sources.
RECOMMEND: Try a Motherboard USB port in the back of the PC (Not add-on card or front usb connector)
Please not that over 80k have shipped and we have received a total of 203 returns which have all been replaced. Please follow your suppliers warranty instructions on purchase as they are all different. If we receive any faulty stock we replace immediatley. Please bear in mind that if the 5v trace is burnt out then some suppliers may not swap out due to the instructions not being followed regarding the DVD cable being the correct way around and this may be classed as physical damage.
We take great care in providing a quality product and many many thousands of users have reported great success. You will always expect a returns rate, however we stand by our warranty and are committed to giving the greatest of customer care.
We have attached a few images to show our test procedures.

This week saw the addition of aerial combat game H.A.W.X. to the Tom Clancy franchise by Ubisoft. Shane Bierwith, brand manager of the project, sat down with Student Life to discuss the game and some of their developmental decisions. "... we have four-person jump-in/jump-out co-op, which is a first for the air combat category. As far as competitive multiplayer is concerned, we have eight-person Team Deathmatch. It's a really fresh take on multiplayer in-air combat. As you level up and get kills in succession, you'll have access to support units, which range from electromagnetic pulses (EMPs) — you'll shock the other planes out of the sky — to altitude limits." Eurogamer's evaluation of the game calls it fun, but also "a victim of the high standards set by the other titles in the Clancy franchise." IGN says it's "very close to being a great game," but criticizes the combat and the mission design.

Newly released today:
features
Written by 2008 Writer’s Guild Award winner, Dave Ellis, Eat Lead is a side-splitting ingenious storyline and setting that’s never been explored before in the shooter genre. Both Will Arnett and Neil Patrick Harris deliver perfectly timed punch lines that will make gamers laugh in hilarity with their solid voice performance as Matt Hazard and Wallace Wellesley
Help classic videogame stars such as Master Chef and Captain Carpenter redeem their dignity against enemy foes like Sting Sniperscope and Sonny Tang and get to the bottom of why all these iconic characters’ worlds converge
Attack enemies with everything from plasma rifles, to sniper rifles and old-west six shooters, the sniper rifle turret, or use a number of different interactive melee moves to help Matt destroy Wally’s legion of back-catalogue videogame characters
An expansive level environment design reflects years of videogame history in a next-gen package including levels that are radically transformed via precisely timed “hack effects” to challenge Matt Hazard with new scenarios throughout each battle
Eat Lead uses a strategic point and cover system that allows gamers to go far beyond simply hiding behind walls when they can move up to, over, between, and around any cover objects with a fluidity never before seen in a game
Eat Lead makes use of the intelligent physics system that includes destructible items and smart objects, where items can be destroyed or moved to blow through cover or act as temporary safe havens throughout the game environment
description
In the world of Eat Lead, however, everything stops being a game and becomes reality when it is clear that Wally is using the new game to bring about Matt’s death once and for all. With only the mysterious “QA” to help him, Matt must fight against zombies, cowboys, space marines and more to keep his game from being over.
With an original storyline by 2008 Writers Guild of America Videogame Writing Award winner, Dave Ellis, Eat Lead’s unique blend of comedy and action will provide gamers with a shooter experience like no other where hardcore gunfire may kill their enemies, but laughs may bust our bellies.

Zoo Games isn’t publishing Raiden Fighters Aces here. Like we suspected earlier Valcon Games is taking care of it. Before snapping up the rights to Raiden Fighters Aces Valcon Games and Japanese publisher Success struck a deal for Shepherd’s Crossing.
The funny thing is Valcon still hasn’t said anything official about Raiden Fighters Aces. The box art clearly has their logo on it and the ESRB rated the game listing Valcon as the publisher. Signs point to a domestic release. All we need now is a concrete release date for the trio of Raiden Fighters Aces games.
Seeing Valcon publish Raiden Fighters Aces is great news. Not just because it’s Raiden Fighters Aces, but this could mean Microsoft is getting more lax when it comes to approving 2D shmups. Remember Castle of Shikigami III was a Wii exclusive here while Japan also saw it on the Xbox 360. Hopefully, 5pb will be able to make a Cave arcade compilation and G.Rev’s Mamoru-kun wa Norowarete Shimatta will get released overseas too.

According to Fudzilla, Microsoft will be ending the mass availability of the Xbox 360 Elite in many parts of the world and plans on positioning it as a more "limited edition" console, as was originally intended.
Supposedly, retailers are less supportive of the higher-priced Elite consoles during these craptacular economic times, because their consumer demand is lower than the Arcade and Pro. As a result, Microsoft may be limiting the console's sales to select retailers in North America and Europe and stop taking Elite orders in other territories sometime during Q2.
The rumored Elite phase-out would allow it to be marketed as a "limited edition" offering, giving MS the option to sell specially themed (and possibly higher priced) Elite bundles when triple-A titles need promotion. (Think the Resident Evil 5 Elite bundle.) Fudzilla also mentions that Microsoft wants to expand the 360's storage capabilities by releasing a standalone drive that's larger than the Elite's current 120GB model.

via Joystiq
Microsoft is offering a $10 discount off Xbox Live Gold subscriptions to those currently set up with free Silver accounts. Ads for $39.99/year Gold accounts have popped up on Xbox.com and within the Xbox 360 interface, causing some confusion as to whether this is a permanent price drop.
Contacted for comment, Microsoft told us that it is "currently running a promotion in-dash that gives Silver members a special opportunity to upgrade to the full benefits of Gold membership at a reduced price for a limited time." Specifically, it's being extended to all current and new Silver accounts, redeemable via the 360's dash and on Xbox.com, and ... doesn't have a set end date, according to MS. But it is time-limited. (Love those invisible time limits!)
Some retailers, including Amazon.com, are offering physical 12-month -- actually, 13-month -- account cards for the same $39.99 price. When asked, Microsoft said that this is no indication of a planned permanent price drop for yearly subscriptions. Sony's PSN crew just smiled.
