Back in July, the Librarian of Congress officially made it legal to jailbreak your iPhone (or any phone). So why is it that the government is trying to prosecute Matthew Crippen for jailbreaking Xbox 360s? If convicted, he could face up to three years in prison, and lawyers are trying to prevent the author of a book about jailbreaking the original Xbox from testifying in Crippen's defense. What kind of law says it's okay to jailbreak the phone in your pocket, but not your gaming console?

Harmonix's Rock Band 3 hit US shelves earlier today - and there was DLC waiting at home for day-one consumers.
A three-pack of The Doors' songs has been made available for free to fans during the first week of launch (Oct. 26-Nov. 1).
The free pack, available through the Rock Band 3 in-game Music Store, includes Light My Fire, Riders on the Storm and Touch Me.
As already announced, an additional nine-pack of songs from The Doors was released today, available for purchase.
More DLC coming to Rock Band 3 in the near future includes tracks from artists including Billy Joel, John Lennon and Bon Jovi.
The game has won handsome reviews. Xbox World 360 gave it 95/100 calling it "close to pefection. It's out in Europe and the rest of the world on Friday.
Meanwhile, Harmonix and EA has revamped the game's official website. When players link their RockBand.com accounts to their Rock Band 3 profiles, all their gameplay goals and achievements will be published to a personalised "My Gameplay" page on RockBand.com.

An Xbox 360 demo for Game Republic's Majin and the Forsaken Kingdom is available to download now.
Queue it up here so it's sitting pretty in your Xbox 360 harddrive when you get home. But know this: it weighs in at 237.4 MB.
What is Majin and the Forsaken Kingdom? It's described as a "new fusion of cooperative stealth and action".
You play a hero alongside the AI-controlled monster Majin. You have to combine your talents to overcome obstacles and horrible beasties. There are "over 30 hours of gameplay" on offer.
Christian Donlan went hands-on in May. "Can Game Republic hit the sweet spot between something tender and something thrilling? Can the developers offer a simple fable that still has room for a bit of substance along the way?" he asked.

Microsoft is unlikely to pillage its back catalogue of Xbox titles for the high definition remake treatment on Xbox 360.
The admission comes from Microsoft Game Studios VP Phil Spencer, who told IGN: “I don't think it's necessarily a bad idea. I'm going to think about it from the customer's perspective, and are we really delivering something of value to the customer at a price that they want?
“We obviously have a lot of new things going on, so the thought of re-doing a bunch of things is probably difficult to just weave into the overall portfolio. If you can provide real value to the customer, there could be possibilities for that, but I don't spend a lot of time thinking about it.”
The assertion flies in the face of what is increasingly becoming an established tactic in the industry. PlayStation platform holder Sony has already released an HD re-working of its God of War duo from PS2, and has further projects on the way.
Ubisoft, too, is to resurrect both Beyond Good & Evil and Prince of Persia for modern consoles while Sega is also revisiting some of its Dreamcast library and releasing them on Xbox Live and PSN.

Grumbling over the prospect of spending $150 on a Kinect sensor? At least you didn't have to drop $30,000 to get your Sonic Free Riders on. The NYT reports that the first Kinect prototype cost Microsoft that much to build -- which kind of makes the fact that Microsoft was able to get that technology into a $150 box (on each sale of which, the Times' Ashlee Vance notes, MS will profit) a bit more impressive.
The article provides a tidbit of new information about how the device recognizes people. In the case of identical, identically-dressed twins, the Kinect's software will evidently distinguish between the two by asking each to identify him or herself. "'If it can't disambiguate, we say, 'Please tell us if you are A or B,'" Xbox director of incubation Alex Kipman said. "Then, you end up with the equivalent of a different bar code." You'll be able to turn your family into bar codes on November 4.

Fable III will have its own midnight launch event at GAME on London's Oxford Street this Thursday.
The event will get underway at 9pm and finish 1am Friday morning, according to the Lionhead Twitter.
Prizes will be given and members of the Lionhead Fable III team will be present.
Fable III hinges around the idea of revolution. There are two distinct parts to the game: leading a revolution and ruling Albion as monarch. Will you be good or will you be evil?

The voice actor who plays Agent 47 in the Hitman series has only gone and confirmed the heavily-rumoured Hitman 5.
"I have been overwhelmingly gratified and humbled by the sheer dedication to the Hitman franchise that the fans have expressed," David Bateson said in an interview with The Gaming Liberty.
"For all the kind things that have been said, I am truly thankful. That kind of dedication and appreciation of the game deserves repayment... with an even more gob smacking instalment in Hitman 5. I don't envy IO Interactive for the pressure they must be under to deliver. I am utterly convinced they will!"
This morning Kane & Lynch developer IO Interactive responded to Bateson's comments. "This is rumour control," it said on its official Twitter account.
"While Bateson's comments are flattering, they are a surprise - we are currently not working on projects with him."
Note IO fails to deny the existence of the game.
This isn't the first we've heard of Hitman 5. In July Eurogamer broke the news that IO was hard at work on the game and that it was set to be released Christmas 2011 at the very earliest.
In the four years since the release of Hitman 4, IO has put out third-person action game Kane & Lynch, its sequel, and cutesy third-person action game Mini Ninjas.
Square Enix told Eurogamer: "It's flattering to see so many fans are eager for another Hitman game. Unfortunately we have nothing to announce at this time."

Sony Computer Entertainment R&D guru Dr. Richard Marks isn't a big fan of the type of controller-free experience Kinect offers.
"I totally agree that there is this magical feeling with using your hands to select something," Marks told the New York Times as part of a Kinect feature.
"But that feeling wears off pretty quickly, and it becomes a pretty cumbersome way to do things," added the man behind EyeToy and PS Move.
According to the report, Sony considered eliminating the need for controllers too, but it came to the conclusion that gamers wouldn't find the experience satisfactory.
Marks gave us a special glimpse into the technical capabilities of Move back in July.

Celebrity geek Andrew “Bunnie” Huang, the designer of the Chumby and author of the 2003 title Hacking the 'Xbox: An Introduction to Reverse Engineering', has agreed to testify for a southern California man charged under the anti-circumvention provisions of the Digital Millennium Copyright Act.
The defendant in the case, 28-year-old Matthew Crippen of Anaheim, allegedly ran a business modding Xbox 360s for between $60 and $80 a pop. He was charged after he performed the silicon surgery for an undercover corporate security investigator with the Entertainment Software Association, then again for an undercover ICE agent. He faces up to three years in prison if convicted of both counts.
But if federal prosecutors have their way, the scheduled Nov. 30 trial in Los Angeles won’t include Huang’s testimony. Prosecutors earlier this month asked the judge presiding over the case to preclude Huang from testifying on the grounds that his testimony would be legally irrelevant. The government says fair use is not a defense (.pdf) to a DMCA charge, and argues that Huang’s legal opinions are inadmissible. A ruling is pending.

With Windows Phone 7 finally out, what does the future hold for Microsoft's line of Zune media players? I suspect that very few people outside of Redmond are asking themselves that question right now-and that anybody who does care assumes that the Zune HD will turn out to be the final stand-alone Zune. (Like all the other Zunes before it, the HD suffered from a malady I like to think of as "Gee, this is quite a good product, but it's in a class of devices that people lost interest in a year ago" syndrome.) Me, I'm hoping for a new Zune soon-maybe several of them. Hold on, hear me out, I'm serious."
I've been muttering about this one for a while: if Microsoft doesn't come out with a media player that's basically a chassis 1 Windows Phone 7 without the phone, they're missing a vital opportunity. If they want to build an ecosystem, they need to both offers consumers connected and non-connected models, and they need to offer developers the most populated platform they can - everything possible capable of running their software. The Zune HD is a great device, but people want apps and enhanced functionality beyond just the basics, and the Zune HD can't deliver that right now (no, the 30 apps so far on the Zune HD really don't count - the damn thing still can't view YouTube videos).
One catch here is that the baseline Windows Phone 7 spec has a lot more ooomph than the Zune HD - a 1 Ghz processor and bigger, higher resolution screen won't come cheap - so if Microsoft can only offer this type of product at the $499 price point, well, that's going to fail...

During an interview with Joystiq at a Kinect pre-launch event in San Francisco, Microsoft Games Studios veep Phil Spencer told us that early retail indication for Kinect is showing strong interest in the new platform. "Pre-order numbers are good," he said. "The retail channel seems to be excited for what we're doing. We feel good about our supply that we can build. I imagine we're going to have to work hard to fill out the demand that's out there, is kind of our sense, but we're willing to work hard so that's fine."
It's good to hear Microsoft is willing to put the work in, since Ubisoft's VP of sales and marketing, Tony Key, thinks the device will be "sold out" at launch. You can look forward to our full interview with Spencer on Monday, which discusses everything from the upcoming Kinect launch to Xbox 360 S dominance in North America over the past four months, and even the PlayStation Move.

In Red Dead Redemption's Land Grab Mode – set for multiplayer free roam as part of the intriguing Undead Nightmare add-on – players fight for control over a section of land in one of seven different towns in the open world epic's online game world.
When one of seven posts marked Land Grab is activated, a countdown triggers and players are given control over a radius of territory, Rockstar revealed on its website.
In order to lay claim to the land, you must remain inside the radius and defend against oncoming enemies. Leaving at any time will surrender your claim, as will being killed by another player.
While the land grab is active you'll add to the XP pot awarded at the end of the match. But watch out for sneaky enemy players – all they need to do is activate the post themselves to take control.
All players can participate in an active Land Grab, Rockstar said, but only players that have the Undead Nightmare Pack can initiate a game. Screens showcasing the mode are below.
The Undead Nightmare add-on will release next week on PlayStation Network and Xbox Live and set you back £7.99 or 800 Microsoft Points (£6.80 / €9.60).
The new campaign sees you attempt to rid the land of a zombie plague. Expect new weapons, new characters and new locations.
Undead Nightmare is the fifth DLC pack for the open world epic, following Outlaws to the End, Legends and Killers, Liars and Cheats, and Hunting and Trading.

If you're a fan of videos featuring commercial actors mugging for the camera and jumping around in a semi-comical manner, you are seriously in luck. That's right, it looks like Ballmer and Co.'s $500 million marketing blitz has resulted in some totally spasmodic TV spots for the Kinect. As befits a technology that emphasizes movement over the controller itself, there is very little actual hardware shown -- but boy, do those kids look like they're having fun! The Fable III Kingmaker smartphone app is leading Microsoft’s marketing rally for the upcoming RPG.
The unique marketing tool has already pulled thousands of potential gamers.
“The response has been phenomenal – over 60,000 people have signed up, which is a fantastic result,” Microsoft’s director of Xbox and Entertainment Stephen McGill told MCV.
“With mobile technology constantly improving and more people purchasing a smartphone, it’s possible to engage with people in other interesting ways.
“Mobile gaming has proven to be a huge success and we are pleased to offer a Fable III experience on the go through Kingmaker.”
The game rewards players for planting virtual flags in a digital civil war between Fable III’s two factions. Any gold earned in Kingmaker can then be transferred to the Xbox 360 when Fable III launches next week.
A partnership with GAME means that anyone who pre-orders the game from the national chain will bag a bonus 15,000 gold. The firm’s stores serve as Kingmaker treasure points for the app’s users.
The app is part of Microsoft’s drive to make Fable III a mainstream hit, earning it a place in what creator Peter Molyneux calls “the triple-A club”.
“It will always be my consistent dream to break into that club,” he told MCV.
Fable III is due for release on October 29th.
