Take-Two pinned its poor financial performance in the three months ending June 30 on poor sales of Max Payne 3 and Spec Ops: The Line.
In a press release to announce the publisher's latest financial results, CEO Strauss Zelnick admitted that sales of the two games were "lower than anticipated", and were the driving factor in Take-Two's results failing to meet expectations. Zelnick, however, remains positive, and little wonder; the company's release schedule for the coming months is mouth-watering.
"Although our first quarter results were below expectations due to lower than anticipated sales of Spec Ops: The Line and Max Payne 3, the outlook for our slate of upcoming releases is stronger than ever," he said. "Early consumer enthusiasm suggests robust demand for our extraordinary lineup, particularly Borderlands 2, NBA 2K13 and BioShock Infinite.
"We continue to expect fiscal 2013 to be one of the best years in Take-Two's history."
And no wonder: the games Zelnick mentions will be joined, one expects, by Grand Theft Auto V - though Rockstar's keenly anticipated sequel sadly wasn't mentioned last night, it's clearly in Zelnick's thoughts. Take-Two's poor results - revenue down by a third, losses up by a factor of almost 13 - are not entirely surprising.Spec Ops was always a relatively niche proposition given its subversive spin on the shooter genre while Max Payne 3 simply didn't have the widespread appeal of Rockstar's past work.
Yet Take-Two has arguably the most enviable release slate in the business. It's ramping up its digital business too, with NBA 2K Online currently in open beta in China, and the company having releases its first social games during the current financial year.

Patrice Désilets, creator of the Assassin's Creed franchise forUbisoft, believes the first game in the series is "the purest" because it gave players a degree of freedom that subsequent games have shied away from.
Speaking to us as part of a feature looking at the making of the firstAssassin's Creed, released in 2007, Désilets - who made a controversial move to THQ in 2010 - admits that giving the player so much freedom meant many missed some of the game's finer moments, something that was addressed in the tighter mission structures of the games that followed.
"I like the first Assassin's Creed because it's the purest one," he tells us. "There's a bunch of stories that you can have, but it's all in your head. You have to create your own adventures. Whereas inAssassin's Creed II, we created the adventures for you and you're following them.
"For me, the first one is an amazing toy. The second one is the real game with rules and missions and it's really precise. But personally I like the poetry of the first one. It's pure."
That purity, Désilets says, afforded greater scope for the sort of emergent moments that typify open-world games, which were further facilitated by the game's setting. While the games that followed typically restricted players to one city at a time, the originalAssassin's Creed let players travel freely between three cities - Jerusalem, Acre and Damascus - and the countryside between them. With so much space, Désilets believes many players missed some of Assassin's Creed's finer moments.
"Out in the kingdom, with your horse, there are so many places with little setups with Crusaders where you can tell a story," he says. "When you get close to Damascus, there's a guy on a stage and he has 35 soldiers in front of him. If you kill him, they all chase you. I played that and it became my little story.
"With Assassin's Creed, our problem was we never actually asked anyone to do it. Most of the players just pass by those setups. But in Assassin's Creed II, we had a mission for all of them."
It's an interesting point; Assassin's Creed was criticised by press and players alike for being repetitive. Our Assassin's Creed reviewbemoaned the game's insistence on players scaling viewpoints, pick-pocketing and intimidating NPCs, sitting on benches eavesdropping and collecting flags. There was much more in Ubisoft Montreal's finely crafted world, but most never saw it, barrelling instead through a succession of near-identical objectives.
Gamers claim to like freedom; Grand Theft Auto games don't sell on the strength of their missions but on the scope they provide for emergent play in a large open world. Désilets claims to have done precisely this with Assassin's Creed, and while the game sold more than 10 million copies, it's the more tightly restricted, linear structures of the games that followed which have reaped critical dividends.
The full story of the making of Assassin's Creed, including its origins as a Prince Of Persia game and how Grand Theft Autoinfluenced Désilets' original designs, is in our new issue. E244should be with subscribers any day now, and will be on newsagent shelves and Apple Newsstand tomorrow, August 1.

When ex-Infinity Ward employees Jason West and Vince Zampella settled their lawsuit with Activision, it was sudden, shocking, and most of all, secret. Activision paid out an undisclosed sum to West and Zampella just before a full trial was set to begin, and while it is expected the exact amount may never be made public, experts can still make an educated guess.
Financial analyst Doug Creutz of Cowen and Company posits that the settlement was worth "tens of millions," Gamespot reports. Considering Activision paid out $42 million to the Infinity Ward Employee Group as part of a separate lawsuit, and West and Zampella were seeking $1 billion when the case reached its bitter peak, this ballpark figure checks out.
Activision will report earnings on Thursday, August 2, and Creutz says he expects investors will ignore the impact of the settlement on Activision's bottom line.

Penny Arcade's On the Rain-Slick Precipice of Darkness 3 is bending the rules of gender and species with a free DLC pack available now on Steam (and set to hit Xbox 360 soon). The free DLC – labeled the "Fanfiction Pack" – adds gender-swapped versions of all playable characters, turning Tycho into Tyche, Gabe into Gabbie, Moira into Manuel, and Jim into Benjamina.
The pack also adds a "furry" option that makes Tycho a lion, Gabe a pony, Moira an American Red Fox and Jim a turtle. Both packs alter gameplay and cutscenes, a feat that took a bit of extra work for Zeboyd, and, as Penny Arcade notes, makes the developer "very cool."

Next-gen console to feature Intel CPU, Nvidia GPU and 8gb memory, says source of leak
The leaked Xbox 720 Durango development kit that went on sale for $10,000 was a real piece of hardware from Microsoft, according to a report.
‘Reliable’ sources working on next-gen triple-A projects have told Digital Foundry that the leaked pictures were in fact genuine.
The source of the leak claimed that the current devkits were released to developers in February, and feature Intel CPUs and Nvidia graphics cards.
He also alleged that the kit includes 8gb of memory, although other sources suggested it was 12gb in total.
The report states however that devkits often featured double the amount of RAM to accommodate debugging tools.

[source: xbmc4xbox.org.uk] I am pleased to announce another release of XBMC4XBOX - v3.2. A number of bugs have been fixed, including a working fix for the lockups when using UPnP. There has been some significant performance improvements also, with the addition of the libjpeg-turbo library. Based on some code from XBMC, and some of our own, we now use this SIMD optimised library for decoding and thumbnailing JPEG images. The speed up is very noticeable – with navigating photos feeling at least twice as fast as before. XBMC4XBOX will now also use less memory when displaying and zooming in on images.

There will be a few surprises for Bond fans when Activision's FPS 007 Legends arrives this October.
It is perhaps to be expected that Daniel Craig will reprise his role as Bond, James Bond himself, given that he lent his likeness and voice to Activision's 007 duo of GoldenEye and Blood Stone in 2010.
But Craig will also be starring alongside some series icons in 007 Legends, with Richard Kiel returning as classic henchman Jaws (pictured). The metal-toothed muscle man will appear in the game's Moonraker mission, alongside that film's villian Hugo Drax - once again voiced by Michael Lonsdale.
Meanwhile, James Bond will team up with one of the new Skyfall Bond Girls, played in both the film and game by Naomie Harris – best known for her role in the Pirates of the Caribbean films. Rory Kinnear will also return as MI6's Chief of Staff Bill Tanner.
There's also some classic Bond talent behind the scenes. Bruce Feirstein is penning 007 Legends' overarching storyline, which links classic films such as Moonraker and On Her Majesty's Secret Service with the upcoming Skyfall.
Feirstein wrote the script for Brosnan films GoldenEye and Tomorrow Never Dies, as well as the plots of Activision's GoldenEye 007 and Blood Stone.
Meanwhile the music will be composed by TV composer Kevin Kiner, who worked with notable Bond composer David Arnold on the GoldenEye 007 game.
007 Legends is due for release on Xbox 360, PS3 and PC on October 19th, with the Skyfall mission made available via DLC at a later date.

eBay user "troxin_kustoms" is selling the custom (and working, he claims) Xbox 360 controller mod you see above, a painted beauty meant to resemble a less advanced, repurposed construction material. Alongside the custom paint job, all of the face buttons and analog sticks have been ripped out in favor of old typewriter keys.
The auction is still going for just over two days, so best act quickly if you're in the US or Canada. Those are the only territories "troxin_kustoms" is willing to ship this thing, probably because the fuel for an overseas dirigible trip would be outrageously expensive.

Mojang, the studio in front of the man behind Minecraft, was working on a first-person shooter with another company, Markus "Notch" Persson tells Joystiq. The collaboration and the project itself is now completely dead, Notch confirms, following today's news of a mysterious cancellation.
The FPS was killed off in the prototype stage, not because it wasn't turning into a good game, but because Mojang "did not want more external dependencies," Notch says. "The success of Minecraft meant we could focus on projects fully owned by us."
Future collaborations aren't out of the question for Mojang, as long as they're "not to make money. If there are other reasons to collaborate, maybe!"
Here's a reason: Portal guns in Minecraft.

The Battlefield 3 "Aftermath" DLC is finally official. After getting leaked a few months ago, and being mentioned again last month, the add-on has now been described in more detail by EA. There will be four new maps that take place in "a post-earthquake Tehran," along with new vehicles, a new game mode, and new assignments, achievements and dog tags to earn.
This promo page also hints at new weapons for Battlefield 3: Aftermath. There's no indication of what the new game mode is just yet, or when the content will drop. Currently, the release date is listed as "TBA" for both premium and standard BF3 players, but given that EA's shared this information with us, the DLC probably isn't too far off.

And just like that, it was all over. Shortly after the well-known, always-informative Major Nelsonannounced that this year's upcoming Xbox Live update had officially opened its beta doors to the public, he soon followed up with a note saying it was already "full and no longer accepting sign-ups." For the lucky ones, though, the public beta will give them early access to a slew of anticipated Xbox Livefeatures, such as personalized dashboard recommendations, improved category / discovery features and, best of all, a look at Internet Explorer on Microsoft's entertainment console. Sadly, Major Nelson didn't say whether or not there's going to be more spaces opening up soon, but we'll keep you in the loop if anything changes.
