The financial guidance offered by Take-Two means that Grand Theft Auto V will be released by April 13th at the latest.
That’s the predictions of Cowen & Company analyst Doug Creutz.
“Full year FY13 guidance for net revenues is $1.75bn-$1.85bn,” Creutz observed. "We believe management could not provide this level of guidance with any degree of confidence if it did not anticipate shipping Grand Theft Auto V during FY13.
"Take-Two's announced line up of titles for FY13 was largely unchanged, including continuing to resist announcing a release date for Grand Theft Auto V. We are modelling a ship date for Grand Theft Auto V in the last two weeks of March 2013."
Wedbush Morgan’s Michael Pachter agrees, adding: "Guidance strongly implies the release of Grand Theft Auto V in FY13. Although management did not provide a release date or window for GTA V, its FY13 revenue guidance is unattainable without a huge seller from Rockstar.
"Management disclosed that the FY13 revenue mix by label is estimated to be 60 per cent Rockstar Games and 40 per cent 2K Games. Rockstar is expected to contribute $1.1bn, with $300m from Max Payne (including DLC) and $150m from catalogue.
“The remaining $650m is simply not possible without the release of GTA V well before FY end.”

Crimson Dragon will careen into Japan on June 13 for 1,200 Microsoft Points ($15), Andriasang reports. Crimson Dragon is a Kinect exclusive created by Panzer Dragoondirector Yukio Futatsugi that will allow players to ride six different types of dragons while shooting fireballs and laser-inspired projectiles.
Yeah, we think it sounds like pretty much the best thing ever, too. Unfortunately, there is no word yet on a western release date.

Public interest should override recommendation, says Florian Mueller

Judge David Shaw's recommendation to the ITC Commission that the import of 4gb and 250gb Xbox slim models to the US should be banned is unlikely to be enforced, says patent expert Florian Mueller.
The judge made the decision to recommend an import ban to the ITC Commission yesterday, ruling in a case between Microsoft and the Google-owned Motorolla which has the Redmond manufacturer defending itself against four counts of patent infringement.
Motorola, on the other hand, stands accused of not offering what are seen as essential patents for use by other companies under fair terms, violating the FRAND agreement by asking for an excessive share of profits.
Whilst Shaw has effectively ruled against Microsoft here, the actual outcome of the case rests heavily on two parallel cases in Europe which will establish whether Motorolla has operated within the terms of FRAND policy.
Nonetheless, even this judgment will be evaluated in the light of its potential effects on other businesses and the public.
"I've never seen an ITC judge make any other recommendation than an exclusion order if his initial determination is that there is a violation," says Mueller. "This is the normal course of business.
"Unlike judges at courts, ITC judges don't make the decisions: they merely recommend them. Their recommendations are very frequently not adopted by the Commission, the six-member decision-making body at the top of the ITC. Not only does the Commission overrule those judges with respect to the actual violations but the Commission also has the final say on remedies."
"The more Xbox games makers write to the ITC about this, the less likely an import ban will be"

Mueller, who runs tech patent blog Foss Patents, also toldGamesIndustry International that developers and publishers are likely to petition the US administration to overturn the ruling.
"Even if the Commission agreed with the judge on some or all of the violations, there are public interest considerations for which an exclusion order should not be entered, or at least not before or during the Christmas Selling Season. The more Xbox games makers write to the ITC about this, the less likely an import ban will be.
"If many games makes write to the ITC, then I doubt that there will be ever be an actual Xbox import ban. What's more likely to happen is that a federal court in Microsoft's home state of Washington will set the terms of a license agreement that Motorola and Microsoft will have to enter into. As a result, Microsoft will be licensed and the Xbox won't be an infringing product."

Analysts chime in on what we'll see at the Xbox press briefing. Don't expect any next-gen talk

E3 2012 is fast approaching, and as usual, the big three platform holders will be holding their respective press conferences on Monday and Tues (June 4 and 5) right before E3 itself officially opens its doors. There have been tons of rumors about Microsoft, Sony and Nintendo, but what should we realistically expect to see?
GamesIndustry International rounded up several leading games analysts to get their take on each of the console manufacturers. In part one, we'll take a look at Microsoft. In parts two and three we'll showcase Sony and Nintendo (which is the actual order of their briefings.)
Microsoft arguably is in the best position (certainly in the US, where the company's Xbox hardware continues to outsell the competition) and at this point in the cycle, it's all about maintaining momentum while trying to expand the audience via Kinect and Xbox Live.
Here's what the analysts had to say.
Jesse Divnich, EEDAR
Microsoft is in a very comfortable position at the moment. I believe their E3 will be focused more on the total entertainment experience the Xbox 360 can deliver. But yes, the typical Halo, Forza, and Fable trailers are likely to be shown, on-top of a few family focused Kinect titles.
The console manufacturer under the least amount of pressure is Microsoft, so I expect them to stick to a similar script as last year. I don't foresee them announcing anything too jaw dropping or off-the-wall. The ball is really in Sony and Nintendo's court to break the current momentum Microsoft has and I don't foresee Microsoft sabotaging that momentum by their own doing with some outside of the box presentation--sorry, Cirque du Soleil is unlikely to make an appearance again.
David Cole, DFC Intelligence
One of the biggest things Microsoft is pushing is the diversity of the Xbox 360. In the new DFC Intelligence report Consoles as Entertainment Hubs, we noted that in March 2012 Microsoft announced that over 50% of time on Xbox Live was spent in non-game related activities. Microsoft's goal is to increase that ratio even more so that the Xbox 360 is a central entertainment hub of the living room. There is a major race to bring entertainment services to consumers both on television sets and mobile devices. While Apple and Google may have an advantage on mobile devices, the Xbox 360 gives Microsoft an edge in the living room.

So Microsoft will clearly focus on the diversity of the Xbox 360 and I expect to see a lot of Kinect products, including unique uses for the Kinect that are non-game related. With that being said I think it is important for Microsoft to show they are not leaving gamers behind. So to that expect to see a focus on a handful of big titles like Halo 4 and some big third-party titles like Call of Duty Black Ops 2.
Billy Pidgeon, M2 Research
I think Microsoft will focus on software and network services at E3 2012. There will be a strong emphasis on hardcore titles including Halo 4, and there will be at least two previously unannounced first party games. I'm also expecting several big third party titles with downloads, characters, modes, or other assets exclusive to Xbox 360.
Although the press event will stress software and services for hardcore gaming, Microsoft must also demonstrate greater influence in the much larger casual games market. Many hardcore gaming enthusiasts probably won't like the coverage of casual games, but Microsoft will throw out some hardcore red meat at regular intervals to keep hardcore fans engaged. Microsoft will demo some quality casual and family entertainment (often with Kinect) and we'll likely hear more about the value of the subscription-subsidized $99 Kinect bundle offer for all sectors, including family and mass market. It's possible Microsoft will announce additional consumer value bundles to stoke hardware sales going forward.
You can bet Master Chief and Halo 4 will make a splash
Microsoft will likely showcase multiple improvements and new features for the Xbox LIVE network. These could include games and entertainment features provided by partners for tiered pricing models similar to premium cable deals. Tiers might include game and entertainment features provided by partners such as EA, ESPN, Netflix. I'd also like to see Microsoft add more value to the free and Gold levels of Xbox LIVE. Free casual games would add great value and would help Microsoft better prepare for competition with upcoming services from Apple and Google.
As Xbox LIVE has systemic connections to other Microsoft networked services and direct connections to web, PC and mobile devices, Microsoft typically promotes these connections to make a case for games as a proprietary cross-platform service. This has been more marketing than action to date, so I am hoping to see a more impressive integration of Xbox LIVE services into web, PC and mobile this year.

Unlikely but wouldn't-that-be-cool surprises Microsoft could unveil: a compelling demo of Kinect control in a hardcore game, an exclusive deal with a cable provider to offer Xbox 360 as a set-top box option, or a peek at next generation software or hardware.

For Microsoft, I think we'll hear a lot more about new XBL content, planned feature/UI enhancements, and their broader vision for opening up digital distribution. There will be blockbuster game trailers and demos to please their core customer base community, but I don't see them taking their foot off the gas in terms of the strategy to go after the entire family and casual gamers with content and services, the "$99" Kinect bundle and so on. That may sound a little vague but I think part of Microsoft's E3 positioning will be to try to preempt demand for Wii U.
I think people will be disappointed by the lack of news about their next-gen Xbox. I could be wrong about this, and there's been a lot of speculation, but I think E3 2013 will be where that big reveal happens. I think cloud gaming will be a significant piece of that platform, so I don't think we'll hear about "instant-on" game availability this year, but I could be reading the tea leaves wrong on this as well.
Scott Steinberg, TechSavvy Global
Expect big news surrounding new everyday entertainment features for Xbox 360, as well as new Kinect games that speak to broad (and potentially enthusiast) audiences too. Microsoft Game Studios will also have a number of large announcements surrounding in-house retail games products, DLC content and downloadable titles for Xbox Live as well.
Further expansion into casual and mainstream markets is expected, as the company continues to pursue its strategy of becoming a bigger part of the connected home living room ecosystem. Limited noise is anticipated around PC titles this year, though news surrounding Windows Phone and its associated features and titles should be prevalent. What you likely won't see is much in the way of information about the next generation of Xbox console systems, with Halo 4 and other properties expected to get a bigger push and the company loathe to cannibalize surrounding media and consumer attention.
Certainly, there will be greater emphasis on an expanding feature set for both Kinect and the base Xbox 360 console set itself, as well as more announcements on the digital and downloadable front. To this extent, news may break surrounding free-to-play gaming, expanded downloadable content offerings and upgrades to the overall Xbox user interface, front-end experience, and Web and multimedia browsing functionality. Expect the company to push both partners' titles (e.g. offerings from Electronic Arts and Activision) and its own unique offerings and franchises, as well as of course provide a marked showing of support from third-party publishers, designed to promote the idea of continued interest in the system even as it enters late maturity in its lifecycle.
Announcements surrounding new entertainment-focused content (e.g. streaming TV options) and online music services are also anticipated. The manufacturer's core messaging will likely center on system differentiation, and future-proofing, with refinements to the Xbox 360's user experience and multimedia capabilities placed front and center.

The second Modern Warfare 3 content drop has arrived on Xbox 360, Activision has announced.
Content Collection #2 packs five new maps: Getaway, Lookout, Sanctuary, Foundation, and Oasis; as well as two spec ops missions in Kill Switch and Iron Clad.
Thus far the content collections are how MW3 DLC has been offered to those without a Call of Duty Elite paid subscription (those who do have been receiving earlier, smaller, and more frequent add-on releases in exchange for subscription costs).
As with the first collection, the DLC will be available for $14.99 (1200 MS Points). Activision added that PS3 and PC releases will arrive at a later date.

Options running out for Microsoft with ITC now one step away from prohibiting console sales, but verdict not yet enacted
Microsoft is feverishly trying to escape one of the most disastrous legal rulings imposed on the company in its thirty-seven-year history, after the International Trade Commission (ITC) was advised on Tuesday to ban the import and sale of Xbox systems in the United States.
Judge David Shaw said Microsoft should be handed a cease-and-desist order on sales of Xbox 360 Slim consoles across the country, as part of an increasingly complex and bitter legal dispute between the company and Motorola Mobility.
The legal war – fought in courtrooms in Germany, the US and an ITC panel – has proven to be extraordinarily expensive for both parties. A Seattle judge recently claimed that attorney fees already spent “could finance a small country”.
But Judge Shaw’s recommendation to the ITC now threatens to throw the Xbox US business into disarray.
He believes Microsoft should not only cease Xbox imports from China, as well as ban general sale of the console across the country, but also pay Motorola Mobility 7 per cent of the value of any unsold systems remaining in stores.

Developers can change XBLIG prices every seven days
Xbox Live Indie Games developers have been issued a new set of relaxed guidelines for pricing game content.
In a move that could stimulate more fluid trading, content creators can now alter the price of their games every seven days.
Previously, developers had to wait 90 days to offer new prices. Other pricing regulations remain unchanged, according to Gamasutra.
Titles below 150MB in size can cost as little as 80 Microsoft Points ($1), going up incrementally to 240 and 400 respectively.
Games sized between 150MB and 500MB can be priced at 240 or 400 Microsoft Points.

Minecraft's XBLA port features local split-screen multiplayer – but only when played on an HDTV, a stipulation that wasn't ... stipulated very clearly. Microsoft announced two efforts to rebuild the shattered relationship between it and SDTV-owning fans who found themselves lacking in modes. The full (but brief) statement is after the break.
First, Microsoft is now issuing refunds to affected customers who contact the publisher through customer support. Second, it is preventing other customers from being Mineshafted by adding clearer notification to the XBLA listing: "To experience split-screen functionality a high-definition television is required."

As a side effect of Activision's ongoing court battle with former Infinity Ward heads Jason West and Vince Zampella, details of the company's deal with Bungie have been made public in documents posted by the LA Times.
According to the documents, Bungie has agreed to create four "sci-fantasy, action shooter games" in a project code-named "Destiny" (for which Bungie filed trademarks last year). The first will be an Xbox exclusive (360 with the option for its successor) in fall 2013 (versions for other systems would follow one year later) with followup games on Xbox successor, PS3 successor, and PC in 2015, 2017, and 2019. Four DLC expansions, code-named "Comet," are included in the deal, due fall 2014, 2016, 2018, and 2020.
In the contract, Activision reserves the right to take over the "Destiny" property if Bungie fails to meet its requirements; however, it stipulates that it will not begin more "Destiny" projects until Bungie has completed its work.
The contract also gives Bungie the freedom to put five percent of its staff to work on a prototype for a new game referred to as "Marathon," with the team size allowed to grow after certain operating income. There are also rules governing how much of the company's staff can work on Bungie.Net, Halo Reach DLC and other projects.
That takes care of the next eight years or so of video game news. Who wants tacos?

The 1.5 update for the Kinect SDK has been released to developers, and it adds a solid list of new capabilities, including something called Kinect Studio (that allows developers to record user movements and play them back for the code later), a development kit for Face Tracking (which enables Kinect to track facial features), and new Human Interface Guidelines and other documentation improvements.
But the marquee feature here is that Microsoft has finally laid to rest the question of whether the Kinect works when seated or not. Now there's a full Seated Skeletal Tracking mode, which only tracks a person's head, torso and arms. Microsoft recommends this not only for when games players are seated, but for any application where the lower half of the body doesn't need to be tracked. Finally, there are also new language packs. In addition to languages like French and Japanese, you get Kinect support for regional differences in languages, like English/Canada and English/Australia. Crikey, devs will be well chuffed about that, etc.

Square Enix has registered URLs for ‘JustCause4’, despite the fact that the publisher has yet to officially announce Just Cause 3.
Fusible uncovered the company’s registering of URLs in several countries through URL proxy registrant Corporation Service Company.
Both Square Enix and Just Cause developer Avalanche Studios are mum on the registration, and in fact one of the last official mentions that the franchise would continue past the second effort came from a 2010 interview on our sister site Develop—where Avalanche head Christofer Sundberg shared that a third entry in the series was very likely.
Beyond all that, there’s not much more to share. Just two weeks out from E3 though, so perhaps we’ll learn something then.

Aliens: Colonial Marines has been delayed, developer Gearbox Software has announced. The game, previously due this autumn, will now be released on February 12 next year.
In a post on the studio's community website, Gearbox presidentRandy Pitchford says that the delay has come from the studio's insistence that quality will not be compromised by deadlines, adding that, by the time it comes out, Colonial Marines will have been in development for roughly the same amount of time as Borderlandsand the original Brothers in Arms.
"We're now at a point in development where we can see the end," he writes. "We know what's left to do and can sufficiently quantify it to be very confident in the schedule for the game's completion and commercial release.
"We're very excited to finally have a firm date, and can't wait for you to step into the boots of a colonial marine and kick some ass."
Colonial Marines, Gearbox's semi-sequel to James Cameron's 1986 film Aliens, was officially announced in February 2008, though Gearbox and publisher Sega first revealed that a new Aliens game was in the works in December 2006. It starred on the cover of Edge 240, and you can read a recent preview of the game here.
It has already been delayed once this year, with its original spring launch window pushed back to autumn. This is the first time the game has had a specific launch date, and to mark the occasion, Gearbox has released the below new trailer.

Game of Thrones, the latest RPG from Cyanide, is set to take over the UK and Ireland on June 8 for Xbox 360, PlayStation 3, and PC. Based on the world first penned by George R.R. Martin, players guide two playable characters through locales both new and familiar to the series.
Players land in Riverspring, a new location to the Game of Thrones world and the home of Alester Sarwyck, who seeks to put a stop to his sister's marriage. Also starring in the game is Mors, a brother of the Night's Watch that guards the wall.

The folks over at Gearbox Software have been busy with a lot more than designing fancy collector's editions, according to Borderlands 2 producer Matt Charles. Answering fan-submitted twitter questions on the PlayStation Blog, Charles addressed several technical problems suffered by Borderlands – by and large, the news is positive.
Voice chat issues that plagued the first game, for instance, are currently being worked on and the system "will be working for everyone when the game launches." Charles also said that while it's "too early for me to give any final numbers," Borderland 2's framerate will "see an improvement over the first game."
He also mentioned the upgraded user interfaces we've talked about before, and that players will now automatically pick up ammo and currency dropped by felled villains: "There's a lot more useful data for gear comparison and also more descriptive text on the item cards as well. Having said that, the best way to know what a gun does is to use it."

[radicade] wanted to know what real life portals would look like; not something out of a game, but actual blue and orange portals on his living room wall. Short of building a portal gun, the only option available to [radicade] was simulating a pair of portals with a Kinect and a projector.
One of the more interesting properties of portals is the ability to see through to the other side – you can look through the blue portal and see the world from the orange portal’s vantage point. [radicade] simulated the perspective of a portal using the head-tracking capabilities of a Kinect.
The Kinect grabs the depth map of a room, and calculates what peering through a portal would look like. This virtual scene is projected onto a wall behind the Kinect, creating the illusion of real-life orange and blue portals.
We’ve seen this kind of pseudo-3D, head tracking display before (1, 2), so it’s no surprise the 3D illusion of portals would carry over to a projected 3D display. You can check out [radicade]‘s portal demo video after the break.
