Ohio-based Impulse Technology is suing Microsoft for allegedly infringing on patents it holds for technology that tracks users' movements and lets them play games without a controller.
Impulse claims that Kinect infringes on seven of its patents covering a "wide variety of games where the movement of a player is tracked in three dimensions ... and certain exercise games where the motion of the player is tracked to effect movement of a virtual avatar, and the exertion of the user is monitored, including where the tracking of the player is done by use of a camera."
According to Patent Arcade, eight game makers - including EA, Sega, and Konami - are named as defendants in the suit too. They're also accused of making exercise games, sports titles and others that violate the patents.
Impulse is seeking a permanent injunction, damages, interest, attorneys' fees and costs.
In January Peter Klein, chief financial officer at Microsoft, labelled Kinect the "fastest-selling consumer electronics device in history".

Microsoft's financial reports for its Entertainment and Devices Division show that Xbox 360 revenue grew by 45 per cent for the year, while the device itself shipped 13.7 million units, an increase on 2010's 10.3 million.
Profit from EDD for the quarter was $32 million. The report also noted that the 360 has been the top selling console in the US over the last 12 months.
"EDD revenue increased primarily reflecting higher Xbox 360 platform revenue. Xbox 360 platform revenue grew $2.7 billion or 48 per cent, led by increased volumes of Xbox 360 consoles, sales of Kinect sensors, and higher Xbox Live revenue," said the firm.
The report also showed a 12 per cent ($119 million) rise in research and development costs for the division over the year, due to an expanded team, and an increase in marketing costs of 12 per cent.
Across all divisions Microsoft's sales for the quarter was $17.37 billion, a rise of eight per cent, and a profit of $5.87 billion, a rise of 30 per cent.
Overall Microsoft sales for the entire fiscal year was $69.94 billion, which represented a $23.15 billion profit.

GE Global Research announced earlier today that it has managed to cram up to 500GB worth of data on a standard DVD-size disc, an increase in storage density of roughly 100x. What's more, the tech arm of conglomerate General Electric Company says that the storage solution will record data at the same speed as Blu-ray discs while increasing storage capacity by 25 times. The Blu-ray Disk Association says that the commonly available 12x speed Blu-ray writers have a maximum writing speed of up to 400Mbps (or 50MBps) which means that in theory, it would take just over three hours to fill that new holographic hard disk. GE has confirmed that its R&D and licensing team will be sampling the media to qualified partners that may be interested in licensing the technology.

Rumours abound that Microsoft may be preparing to unveil the next Xbox at E3 2012, but according to Kinect Sports developer Rare, the next-gen is already here.
Speaking at the Develop conference in Brighton this evening, Rare chief Scott Henson dismissed next-gen questions, pointing towards Microsoft's ability to improve gaming experiences through software.
"One of my favourite things is, Scott, tell me when next-gen is. Tell me when that's going to happen. This has been the last ten years of my life. When's next-gen? When's next-gen? When's the new Xbox Live? When's the new Xbox?" he said.
"The power of software, the power of services, and the power of platforms is that it's always now. We continue to build on them, continue to innovate, continue to push, and we continue to build magic."
In a Eurogamer investigation into the new Xbox and the PlayStation 4, published this morning, Crysis 2 developer Crytek UK and Gears of War 3 maker Epic Games said current DirectX 11-fuelled visuals provide a good indication of what will be possible on the next round of home consoles.
Avatar-quality graphics are a realistic possibility, we were told.
Going one step beyond that, Henson said motion-sensing add-on Kinect puts gamers one step closer to simulating the Star Trek-style holodeck in their living rooms.
"I'm not going to give you the exact date you're going to have a holodeck in your room, but think about that for just a second," he said.
"Think about the movies we all grew up on and the things that inspired us in lots of different ways to create the kind of entertainment to do. We're down that path. We're absolutely down that path right now."
But before you set your phasers to stun and ask Scottie to beam you up, know this: Henson reckons it'll be a long while before the holodeck becomes a reality.
"You see advancements in televisions," he said. "When we stood up and we said it's the HD era in 2005 and HD is now – I remember because I wrote the speech and I was at GDC in 2005 and we gave away TVs, it was awesome. And here we are in 2011 and HD TVs are pretty pervasive, but they're still in only about half the homes around the world. It's not everywhere yet.
"When will the holodeck happen? It's going to be a journey. I don't think there's going to be a date."

Need a little extra unlocked WP7 incentive to keep you from buying those oh-so-distracting iOS and Android devices? Well, that official homebrew love is going to cost you -- $9 to be exact. We already knew the Microsoft-sanctioned ChevronWP7 Labs would be open for business soon, but recent tweets from the jailbreaking outfit's Chris Walsh have shed a little more light on the process. In addition to the nominal fee users will have to fork over for the official unlock, Walsh also points out that software updates to Mango and Nodo will close any security holes in the platform. So, if you were planning on getting your pirate-y hands dirty hacking away at WP7, think again -- Microsoft's still got the keys to its mobile OS' house.

Xbox Live Arcade offers many developers a great opportunity, spotlighting their games in front of a large audience every Wednesday. As a result, there's obviously plenty of competition to get games on the service. In a recent interview with Gamasutra, Xbox Live Arcade first-party director of publishing Ted Woolsey offered some advice for would be Xbox Live Arcade developers.
Woolsey's key advice is for developers to present something different from other offerings on the service. Getting the pitch right is important as well, with Woolsey noting that developers should "get all the great ideas you have out and make sure that they're understandable." In addition to coming up with new concepts, Woolsey also stated that Microsoft is "looking at different business models" and is "aware of what's going on out in the greater games community." Perhaps the Xbox Live free-to-play rumors are coming true after all.
Woolsey also offered other details about XBLA, notably that there are typically around 50 XBLA games in development, with about 30 being published in a given year. With so many titles, Microsoft is keen to expand on promotions like Summer of Arcade in order to offer more exposure to various games. Furthermore, Woolsey added that the upcoming 360 dashboard update should make browsing for games a less confusing process.

Microsoft has reasserted that developers are not being forced to incorporate Kinect functionality into their Xbox 360 games and that Kinect functionality will not be forced on core gamers.
"I don’t think we’re trying to put any input paradigm, enforce that on anyone, unless it’s better,” Xbox CFO Dennis Durkin told IndustryGamers. “We’re not trying to force anything.
“If people want to do it and they think it enhances the experience, I think consumers will embrace it and they’ll do it, but that’s the bar that they’ll expect. And there will be a bunch of experimentation, some of it will work and some of it won’t. The things that work, people will emulate and they’ll chase and the things that don’t, people will try other experiments.”
"I think one part of Kinect is making sure that Kinect is relevant for whatever audience you have. We certainly have a core audience. We want to make sure that Kinect experiences are great for them. But the key word in that is experiences. And it’s got to be experience driven.
“So we’re not dogmatic about, 'Hey, no controller. It's go to be 100 per cent no controller’. What you’re seeing is a lot of experimentation across that spectrum of, 'Hey, here’s a totally controller based experience that’s been a controller based experience for 10 years, so people are very, very ingrained in how they interact in that experience’, to, 'Here’s the other end of the spectrum, which is a totally Kinect-based experience. You don’t need a controller’.

Motion-controlled Xbox Live social hub Avatar Kinect launches on 27th July, according to Microsoft insiders.
WinRumours' sources claim that the service will be made available for free as part of the Fun Labs set-up announced at E3 last month.
First announced at CES back in January, Avatar Kinect lets you shoot the breeze with your friends' avatars in one of 15 different virtual settings.
The app will reportedly track your facial movements and map them onto your avatar while you chat.
We're awaiting comment from Microsoft now, and will update if it offers anything more concrete.

Gran Turismo, The Legend of Zelda, Super Mario Bros – these are some of gaming’s biggest IPs, but Microsoft has said that its selection of first party trounces them all.
That’s according to Xbox CFO Dennis Durkin, who in an interview with IndustryGamers reacted badly when it was suggested that more developers need to be added to the Microsoft Game Studios programme in order to compete with Sony and Nintendo.
"I would ask you to go and look at some of your data,” he retorted. “Compare first party performance over the course of this lifecycle, because I think our first party performance in terms of quality bars and units per title this shift has been superior to our competition’s.
"But certainly we think first party is an important tool and you can’t dispute titles like Forza, which has consistently come out on a repeated cadence and sold multi-million units. You can’t dispute things like Fable, which again, on a very consistent pace, has come out and sold 2 and 3 million units a pop. And now new titles, like Kinect Sports, which has come out and sold over 3m units.
“So we are, not only building existing IP and incubating around titles like Halo and others, but really building new IP in new areas. And that’s going to be core to us... to build those experiences and monetize those."

Technology company AMD reckons the next Xbox will be so powerful it will be capable of reproducing graphics on a par with James Cameron's movie blockbuster Avatar.
AMD, rumoured to be providing the graphics technology powering the next Xbox, said in the latest issue of the US version of the Official Xbox Magazine (reported by the Examiner) gamers should expect radical improvements to AI and physics.
Director of ISV relationships at AMD, Neal Robison, said the unannounced console will allow developers to make every pedestrian in a game such as Grand Theft Auto or Saints Row have a totally individual mentality so they react to the player in different ways.
Crowds will reportedly act as individuals rather than predictable mobs.
The Xbox 360 uses AMD's ATI Xenos to power its visuals. AMD refused to confirm whether it was working on the next Xbox.
Last month id Software programming legend John Carmack told Eurogamer the next generation of consoles will be ten times as powerful as the current generation.
Before that, Unreal Engine maker Epic Games released a real-time demo called Samaritan, below, it hopes provides a glimpse into the future of home console visuals.
The next Xbox is rumoured to be set for an E3 2012 reveal.

The space-saving Nyko Kinect Zoom Lens accessory will arrive in the UK on August 23rd, a retailer has told MCV.
A spokesperson for UK-based online store GamingZap said the Lens will be in stock on that date. The retailer has already seen a high number of pre-orders for the device.
Nyko claims the Kinect Zoom Lens for Xbox 360 reduces the space required to play Kinect by up to 40 per cent. It simply attaches to the top of the motion accessory and adjusts its viewing angle.
The news comes following Nyko’s announcement that the Zoom Lens will arrive in the US on the same date for $29.99.
“The success of the Zoom at E3 was outstanding and we are incredibly excited to help expand the already thriving fanbase of Kinect gamers, allowing even more people to enjoy the thrills of being the controller,” said Nyko’s director of marketing Chris Arbogast.

Enriqxxx and others over at elotrolado.net have managed to dump the 0225 (DG-16D4S) drive key using Jungleflasher and cheap off-the-shelf USB to SATA adapter. In short I think the method works like this: Run JungleFlasher in Windows. Connect the USB/SATA adapter to the 0225 drive in the Xbox 360 with the console powered off and the other end to PC via USB. Turn on the Xbox 360, then open and close drive tray. Disconnect the SATA adapter and connect the drive to a SATA port on the PC. Extract the key by selecting the SATA port in question from JungleFlasher. Done! Thanks goes to jimbox for the heads up."

In 2009, while Microsoft was busy designing and marketing what would become the Kinect, [Carlos Anzola], an inventor, tinkerer, and self-ascribed geek from Bogotá, Colombia, had been working for years on a nearly identical gesture interface for the PC. His creation, the Human interface Electronic Device, or HiE-D – pronounced ‘Heidi’ - was capable of gesture recognition years before Microsoft would release the Kinect.
After developing his gesture recognition device in 2007, Microsoft showed interest in [Carlos]‘ device – going so far as to request a prototype. Microsoft suggested that he should apply for a patent on his technology. [Carlos] did just that, sending in patent applications to both the United States Patent and Trademark Office and the World Intellectual Property Organization a mere two days before the announcement of Project Natal and a full seven months before Microsoft applied for their Kinect patent.
Since the release of the Kinect, [Carlos] has been showing the HiE-D around Bogotá and has put a few videos of his technology up on Youtube, one of which can be seen below. You can also check out his Youtube channel for some great demos.
