Daniel Petric, the teenager who shot and killed his mother and injured his father after being cut off from his precious Halo 3 back in 2007, received his sentence today, MSNBC reports. Judge James Burge sentenced the boy to 23 years to cries of mercy from the boy's surviving father, who stated that Daniel "still does not understand why he did something so terrible."
Daniel's sentence is actually a lot lighter than it could have been, as the prosecution was pushing for the maximum sentence of life without parole. The defense's argument was that Daniel was so young and so addicted to the game that he could not be held accountable. Petric, only 17 years old, was even younger when he committed the crime, and the judge's lenience is likely tied to his belief that young Daniel was addicted to the point of delusion.

Ready for a double dose of Tegra newsbits? We've been wondering what's packed in the Zune HD for some time now, but apparently PC Perspective has had the answer since Computex and didn't realize the newsworthiness until now. According to the article, NVIDIA staffers told the site that its uber-powerful Tegra processor will be the heart and soul of Microsoft's revised PMP. There's been no official word from anyone, and for all we know it might've been some (possibly misinformed) employee mouthing off for kicks. If true, however, it'd be one helluva 'screw you' from Microsoft to Windows Mobile fans, who've been waiting over a year at this point to see some retail hardware running on NVIDIA's mobile platform. We've put in calls to both companies for some sort of statement, but we're not getting our hopes up.
In other news, a group of researchers from Georgia Tech and Savannah College of Art and Design are showing off some of CPU's impressive potential with an augmented reality game ARhrrrr. Using a Tegra-powered mobile dev kit, the game projects a 3D town based on a two-dimensional diagram where you tap the screen to shoot zombies, or lay Skittles in real life to serve as virtual bombs. We've seen similar implementations before, but we're admittedly quite infatuated with this one, and as a bonus, there's video of the demo after the break.

Imagine: Your company makes a hit game (and gets bundled with a hit beta). The publisher won't green light a sequel, so your team begins work on another franchise. Then the sequel is awarded to a developer ... in your own town, who permanently borrows your talent. With all that said, it's understandable that Realtime Worlds CEO David Jones was a "bit miffed at Microsoft" for giving the Crackdown sequel to start-up Ruffian Games.
Speaking with GI.biz, Jones explains that Realtime Worlds was all set to do a sequel before Crackdown's release. When the company didn't receive the go-ahead from Microsoft, it moved on to create APB. Jones wishes that Microsoft had chosen one of its shuttered internal studios to make the game instead of going with Ruffian Games, a company that's in the same town and takes from the same talent pool. He notes it's "challenging to get enough developers in one region as it is." Maybe Realtime can get the third title in the series? Trade off like Infinity Ward and Treyarch did with the Call of Duty series

Someday, we'll talk about third-party exclusives like the way we talk about car phones, Laserdiscs and troll dolls -- a thing of the past. That someday could be sooner than you think, if Microsoft exec Shane Kim is to be believed. "[Microsoft has] said for a long time that a key part of our strategy with Xbox 360 was a level third-party playing field," Kim tells Gamasutra in a recent interview. "Now we've effectively done that with Metal Gear Solid [Rising] coming to the Xbox 360."
Short of a blank check from Microsoft or Sony -- like, what was the asking price for Agent exclusivity, you know? -- there's little incentive for a third-party publisher to release a big-budget game for only Xbox 360 or PS3. It's possible that third-party exclusives will flourish as small, downloadable games and DLC (though those GTA IV add-ons weren't cheap for Microsoft), but it's more likely that they'll diminish as cheap carnival games -- geddit? Of course, with Microsoft and Sony designing their own waggleware apparatuses, such low-grade third-party exclusives won't necessarily continue to be exclusive, either.
Still, Kim argues that "exclusive content is really important." And so, it's up to the first-party publishers to essentially unlevel the playing field with their own IPs. "[It's] really not about relying on third parties, because I don't think that that is sustainable, as we've proven," Kim concludes. "And it's up to each of us to differentiate on our own."

When the Jasper motherboards started showing up in Xbox 360 consoles late last year there was reason for excitement -- quieter fans, more efficient design, and 256MB of internal storage to set gamers free of overpriced memory cards. Now the systems are receiving an unannounced storage boost, with an XboxHacker forum member braza noticing that his Japanese Arcade model sported a 4GB 4Gb Samsung NAND chip. That's twice the size of the old one, giving the equivalent of a 512MB internal memory unit. That first system was manufactured in April, and they're starting to hit US Arcade units as well. As of now we're not sure if there's a way to tell from outside the box whether you have this beefier revision of Jasper, but we're sure your local retailer wouldn't mind if you just bought their entire stock of consoles and ripped them all open to see.
Update: Oops, that's a 4Gb (gigabits) NAND chip, allowing for roughly 512MB (megabytes) of internal storage.

Here at CasualGaming.biz we’ve always been big supporters of ThatGameCompany and its two PSN-only titles, flOw and flOwer. However, it seems that the man behind the studio isn’t keen on reciprocating the sentiment.
Speaking to Kotaku, ThatGameCompany’s creative director Jenova Chan stated: “Casual games are too shallow. What [our games] are is easy to get into. We want to make a new, yet totally accessible experience.
“Games need different hues of colour. Novels and films have many different genres. Games are mostly action. Most focus on primal feelings. And the industry is constantly producing Hollywood summer blockbusters.”
It has also been revealed that ThatGameCompany’s exclusivity deal with PlayStation is only for three titles, meaning that after the release of its next project the studio will be free to develop for any platform – opening the door to a possible debut on Xbox 360.
Chen could yet choose to stick with Sony, however. Sony Santa Monica's external product development direct Tina Kowalewski is a big fan of the team, stating: “New concepts like flOwer which really go outside traditional design can sometimes be hard to communicate to consumers and even internally.
“At Sony we would like to think we have the foresight to take well-calculated risks which provide us content players cannot find anywhere else and production schedules which make such risks viable.”
And of the firm’s next title, the details of which are still unknown, Chan added: “This new game is slightly larger and more of a challenge. The game concept is big. It's risky.”

If you were wondering how the Zune HD could pack in such iPod touch-beating smoothness into such a small size, we might have an answer for you: It's packing Nvidia's teeny, high-performance Tegra processor.
As we explained in our Giz Explains: Low-Power Chipsets, Nvidia's Tegra proc is designed to handle high-def video and Flash with buttery smoothness in small packages, just like the Zune HD. So while this is as yet still unconfirmed, given that we haven't had confirmation from Microsoft, it makes a lot of sense and would actually be a very smart move—and the sources reporting the rumor seem very certain that it's true. With a Tegra processor, the Zune HD would certainly be able to decode videos with far less necessary power than with any other chipset, which means better battery life combined with better video quality. What else could you want from a next-gen PMP?

Natal could be capable of a lot more than was originally thought. Gameplayer has some information about how the technology will function in multiplayer, and goes on to reveal how it is intelligent enough to give full-bodied virtual movement to disabled gamers. The site had previously revealed that the Natal dev kits have been with developers for a couple of months, suggesting that the device may not be as far off as has been suggested by some media outlets

When Max Payne again reappears on consoles this winter, it appears as though he'll be stepping into a much different setting. According to a cover story in issue 195 of Game Informer, the new title will not be taking place in the dark streets, warehouses, and construction yards of New York, but in Sao Paulo, Brazil. Max was booted from the New York Police Department and spent the following 12 years battling his inner demons and addictions, and at some point he moved out to the Brazilian metropolis to escape from his previous life. It appears once again he'll be drawn into elements undesirable, as his work as a security agent for a rich local family leads him into life-threatening situations.
In addition to the different setting, Max has undergone quite a few physical changes. He's burlier this time around, sports a beard and a shaved head, and appears to have ditched the long coat and black getup from the previous games in favor of a stained white sleeveless shirt and cargo pants. Screens included in the article also show a much brighter setting, making it appear like many of the venues for action in the third game take place while the sun is out. Rockstar did mention a few levels could take place at night or in the rain, and pointed out that achieving a 'noir' kind of feel is more about style than about a specific location or color.
Rockstar won't be using voice actor James McCaffrey again, saying it wouldn't really fit considering how much Max has aged. The talent being used won't be a big recognizable name, but Rockstar is confident it'll be appropriate, and the studio plans on giving Max plenty of lines of internal dialogue in the style of the previous games. Many details of the new plot aren't yet being talked about, but Rockstar told Game Informer players can expect it to include the elements of betrayal and violence the series is known for.
To build the new setting, Rockstar sent crews down to Sao Paulo to take note of environmental layouts and soak in the local flavor. The company believes it'll be able to put together some interesting locations for shootouts, with enemies being able to pop out of all sorts of unexpected spots as Max moves through the streets of shanty towns. This third game is being handled by Rockstar Vancouver instead of Remedy, the developer of the original games currently busy with Alan Wake.
One of the big questions Rockstar Vancouver is trying to answer with this game is how to evolve the third-person shooting mechanics of the franchise to make them feel new again. With the first two, the bullet time system that let Max slow down those around him while performing dives and dodges and blasting bullets was unique enough to stand out. The third game will still feature a bullet time system, but will also include a number of other features that have to do with animation and interaction with the environment to ensure the gameplay feels distinct.
The game is being built with Rockstar's RAGE, used to build past games like Grand Theft Auto IV, in combination with NaturalMotion's Euphoria technology that allows for enemies to react realistically to being hit by gunfire and as they impact things in the environment, which Rockstar is hoping delivers a greater sense of realism. To protect himself from incoming bullets, Max will also be able to take cover behind objects as well as grab enemies to use them as human shields, though taking advantage of the cover system isn't required for success. It seems quite a few bits of the environment will also be destructible, so perhaps not every bit of cover will be all that reliable.
Something called environmental bullet time is being built into the game, which according to the article can be compared to quick-time events in other titles. Yet instead of doing something like tapping a button within a small window of time, the player will have full control of Max as the event progresses. Rockstar provided one example to Game Informer, where Max slides down a tin roof in slow motion while tagging nearby enemies with bullets.
This won't be an open-world game, though it seems Max will have a limited ability to scale walls and access combat areas from a few different directions. A bullet-cam, which follows projectiles into their targets, will be implemented into the game to add more style, and it seems Max will be able to perform life-saving kill shots should he be near death. If he manages to kill his killer before the screen goes black, he'll spring back to life thanks to an adrenaline boost.
What Game Informer seemed most impressed by were the animations and attention to detail in the environments, which were said to enhance the gunplay and feel of the game. While hardly anything was said about the multiplayer, it was confirmed that there will be an online component in the PlayStation 3, Xbox 360, and PC version of the game.

Electronic Arts Inc. (NASDAQ: ERTS) today announced details on the exclusive driver profile system in Need for Speed™ SHIFT. Driver profile is the ultimate extension of the true driver's experience. Extending through the single player career and online multiplayer modes, driver profile gives each player a unique game experience based on the way each player drives on the track. This exclusive driver profile system pushes the entire racing genre forward.
During this year's Electronic Entertainment Expo (E3) in Los Angeles, EA invited attendees to participate in a Need for Speed SHIFT Hero Car Competition that showcased the driver profile. Competitors raced around the Autopolis track in the BMW M3 GT2 hero car generating the highest number of driver profile points. The winner of the Need for Speed SHIFT Hero Car Competition, Mitchell Francis, from Los Angeles won a brand new 2009 BMW M3 Coupe.
Driver profile is a tailor-made career mode based on four key game play components:

Cygnos360 is a chip that allows you to have more than one kernel version on your xbox 360. Currently users can only have either a kernel version (4532 or 4548) OR the current kernel version that is neccessary to use xbox live. Cygnos360 enables you to conveniently switch between your "live kernel" and your "homebrew kernel".
You can also use Cygnos360 to switch between PAL and NTSC kernels.

Gearbox Software president Randy Pitchford has confirmed that shooter Aliens: Colonial Marines will not arrive this year.
Publisher SEGA said as much when announcing Aliens vs. Predator, which will be the first of the Aliens trio (Colonial Marines, Obsidian RPG, AVP) to see the light of day in early 2010.
SEGA announced an Aliens FPS (Colonial Marines) and RPG (by developer Obsidian) shortly after signing the Aliens franchise from 20th Century Fox in December 2006.
The solidity of either project has been questionable. Colonial Marines remains the more tangible, having been promised a "late 2008" release before being pushed into 2009 and now 2010. The Aliens RPG, on the other hand, still has no official name nor details.
Both Gearbox and Obsidian are, and have been, busy working on other major titles. Obsidian is making spy RPG Alpha Protocol for SEGA, which is due on PC, PS3 and 360 this October.
Gearbox has delivered Samba de Amigo on Wii and Brothers in Arms: Hell's Highway on PC, PS3 and 360, and is working on meaty openworld shooter Borderlands for PC, PS3 and 360. Furthermore, Pitchford says Gearbox is working on another two unannounced projects. Busy bees.
Aliens vs. Predator, incidentally, is being made by original AVP team Rebellion. Catch-up with the E3 content over on our AVP gamepages.

Sources close to Microsoft have downplayed 1UP's report that a new Xbox console will launch in autumn 2010.
Aaron Greenberg, director of product management, told Eurogamer: "I think part of the excitement about this announcement is that in many ways we are delivering a next generation experience this generation. With that said, I can confirm that Natal will run on Xbox 360 so no new console investment will be necessary."
Another senior Microsoft source familiar with Project Natal said: "Don't believe nonsense on the internet is all I'll say. We'll do the right thing for Natal."
On Friday 1UP reported that a new Xbox console would launch in autumn 2010 with slightly improved hardware and backwards compatibility with Xbox 360.
Rich Leadbetter, editor of Eurogamer's Digital Foundry channel, also casts doubt on the prospect of an autumn 2010 launch for a new console.
"The fact is that an enhanced Xbox 360 is rather unlikely simply because the tech requires none of the console's processing might to sift through the data acquired by the 3D camera," he wrote.
"All of the really clever stuff that Natal does is carried out onboard [the camera device], with the data then streamed across to the 360 via USB. If, as the 1UP report suggests, the 360 update is only offering a minimal amount of extra power, then the question surely must be, what's the point of that?"
Yesterday, TeamXbox also weighed in, claiming that Microsoft's next new console would not launch in 2010 because it would feature built-in Natal technology and "full HD stereoscopic 3D visuals", which would rely on new televisions.

Court papers expose one view of the Duke Nukem breakdown, alleging 3DR held an “offshore account”
Further lawsuit documents have exposed the strained conflict between publisher Take-Two and developer 3D Realms that took place behind closed doors.
New papers suggest that a growing internal rift between 3D Realms and Take-Two reached breaking point during negotiations regarding the development of an Xbox 360 edition of the now-cancelled Duke Nukem Forever [DNF].
Take-Two has also made an extraordinary claim in its lawsuit filing, alleging that 3D Realms has attained a “substantial amount of funds” deposited in an off-shore bank account which would have been appropriate in funding the development of the game.
In May it was revealed that 3D Realms had shut down development of Duke Nukem Forever, said to be due to lack of funding, during a time when the developer was in heated legal dispute with its publishing partner Take-Two.
Yet Take-Two has claimed in a recently-unearthed court document that it did not approve of 3D Realms’ decision to terminate development of Duke Nukem Forever.
Alleging that a contract had been established between developer and publisher to deliver Duke Nukem Forever “in a timely and successful manner”, Take-Two is now seeking $12 million in damages from 3D Realms’ alleged breach of contract.
Using 3D Realms’ legal name – Apogee Software – the court document claims:
“Apogee repeatedly assured both Take-Two and the videogame community that it would use its best efforts to complete Duke Nukem Forever [DNF] in a timely manner.”
“During the initial public announcement about DNF in April 1997, Apogee stated its intent to release DNF by mid-1998. It did not. In December 1999, Apogee made a public statement suggesting that DNF would be released in 2000. It was not.”
“Likewise, in December 2000, Apogee made a public statement suggesting that DNF would be released in 2001. It was not. In 2003, Apogee informed Take-Two that it expected to finish DNF by the end of 204 or beginning of 2005. It did not.”
The public documents were originally discovered by Shacknews. The documents are available here [pdf].
The strained partnership between the two companies finally fractured when Take-Two approached 3D Realms with an idea to develop an Xbox 360 port of the game as well as continue its work on the PC version.
“Rather than develop the Xbox 360 version itself or hire another developer to do so, Take-Two solicited Apogee about expanding Apogee’s current development of the PC version of DNF to include an Xbox 360 version,” read the lawsuit.
“The parties entered into negotiation at this point.”
It is at this stage where Take-Two claims that 3D Realms asked Take-Two to “fully fund” the studio to reach its targets in development of both PC and Xbox 360 editions of the game.
“In light of extensive delays in the development of the PC version, Take-Two was reluctant to lend Apogee such significant sums of money without reasonable assurances that Apogee would make timely and meaningful progress in the development of DNF,” read the plaintiff’s statement.
Take-Two then went on to claim that it offered to fund half of the "concurrent development" costs to the point where 3D Realms reached the project’s Alpha stage, while the other half was promised would be paid upon completion of the game. This is where negotiations broke down.
Of this turning point in the publisher-developer partnership, 3D Realms have vehemently contested this account of events. In a recent press release, the company alleged that:
“Take-Two was well aware that 3D Realms needed the funding to continue the DNF game development. Suddenly, after months of negotiations, Take-Two materially changed the parameters of the proposed funding agreement.”
“3D Realms informed Take-Two that it could not financially afford the changes Take-Two was suggesting and would be forced to release the team if an agreement was not reached. Take-Two made a last minute proposal to acquire the Duke Nukem franchise and the 3D Realms development team.”
“Take-Two's proposal was unacceptable to 3D Realms for many reasons, including no upfront money, no guarantee minimum payment, and no guarantee to complete the DNF game. From 3D Realms' perspective, we viewed Take-Two as trying to acquire the Duke Nukem franchise in a ‘fire sale.’”
In contrast, Take-Two has made an extraordinary claim in its lawsuit alleging that 3D Realms “has title to a substantial amount of funds deposited in an off-shore account,” which Take-Two believes Apogee can use to fund its outstanding obligations.
The Duke Nukem team was axed just days after negotiations collapsed. Take-Two has also made legal claims against 3D Realms for shutting down development. The publisher alleges that it had a contractual right to develop an Xbox 360 version of the game, which 3D Realms was obligated to provide source code to.
No verdict has been reached.

From TeamXbox, the same site that may or may not have broken news on a PSP-like Microsoft handheld, comes a marked rumor about the next Xbox.
...in addition to built-in Natal tech, a key feature of the next Xbox would be full HD stereoscopic 3D visuals similar to 3D movie theatres.
And that's everything they said on the matter.
So while the Xbox 360 would be getting Natal, the Xbox 720 (or whatever you want to call it) could have Natal and 3D immersion. TeamXbox claims that the 720 won't be launched until 3D television solutions go more mainstream, which by my guesstimation won't happen within four years.
Still, with Hollywood's focus on 3D, it's not hard to believe that Microsoft would design their home entertainment console to match—even if the risk would be huge.
But for now, this is all just rumor. If TeamXbox's portable Xbox story comes to fruition, we'll allow ourselves to get a little more excited.

If Xbox LIVE doesn't work for you today, there's good reason. Microsoft planned the outage for maintenance. "On Tuesday, June 16 beginning at 12:01 a.m. to 11:59 p.m. PDT (2009-06-16 0701 to 2009-06-17 0659 UTC) Xbox LIVE and Xbox.com will be offline for scheduled maintenance." In other news, PSN should be online, but it's still a bitter disappointment.

The launch of Microsoft's Xbox 360 motion peripheral, Project Natal will be as big as that of the Xbox 360 itself.
That's according to Xbox 360 strategy boss Shane Kim, who told Kotaku that the motion came has "got to have a great launch line-up" before Microsoft's introduces it to the shops.
"Conceptually, the launch of Natal will be like the launch of Xbox 360," he said. "It's going to be that big. We're not just going to ship it when the hardware and software are ready.
"We have to make sure that there are enough content experiences that are really good. That's similar to how you would think of the launch of a new console. It's got to have a great launch line-up. That's the same thing here." That's probably why it's put Rare to work on Natal games.
On the audience MS hopes to capture with the add-on, Kim said: "We're not focused on this generation's casual gamers or even PS2 people who haven't upgraded. This is about the 60% of households were a video game console doesn't exist... the problem is that the controller is a barrier for some people and now with Project Natal we completely eliminate that."
The chances of us seeing the Xbox 720 within the next three years could literally depend on how the Natal launch goes. When will it happen? "2010 at the earliest," we're told...
