Datel's antitrust lawsuit against Microsoft will continue, now that a US District Court has rejected Microsoft's motion to dismiss the case. In all, five of Datel's six allegations against the Xbox 360 maker will be weighed. The court did dismiss Datel's claim that Microsoft would be blocking the company from competing in the console market, since Datel does not actually manufacture game consoles. The antitrust case claims that by locking out Datel's Max Memory Card with a firmware update, Microsoft used its status as the platform holder to unlawfully prevent competition. In Microsoft's motion to dismiss, it claimed that language in the "Additional Terms and Conditions" clause in the Xbox 360 product warranty barred the use of unauthorized peripherals. The company back upped its case by citing Apple's successful defense of its right to limit use of OS X to its own hardware.
The court rejected Microsoft's motion, however, finding the language in the "Additional Terms and Conditions" vague and too wide-reaching. For example, if Microsoft's interpretation of the terms was accepted, it could prevent the use of certain televisions with the console.
Since Datel's suit was first filed, of course, Microsoft has enabled the use any USB drive as a memory unit for the Xbox 360, which means that even if Datel is able to continue to sell the device, there likely won't be much demand for it. Meanwhile, Microsoft recently filed its own suit against Datel over claims that one of Datel's controllers is too similar in design to the official Xbox 360 gamepad.

Rockstar has told Eurogamer it cannot comment on how long the Grand Theft Auto IV downloadable content was exclusive to Xbox 360, although in hindsight it appears to have been a 12-month deal.
Just under 14 months elapsed between The Lost and Damned appearing on Xbox Live and its eventual appearance on PS3 this month, suggesting the deal may have been measured from the release of the first add-on (the second, The Ballad of Gay Tony, arrived relatively recently on Xbox 360 and is already available for PS3).
Microsoft also wouldn't verify the length of the exclusivity deal to Eurogamer. The platform holder reportedly paid millions and millions of dollars to secure it in 2006. Sony pointed us back to Rockstar and Microsoft.

Disney and Black Rock Studio have put a demo of Split/Second on Xbox Live Marketplace.
You can queue the 808MB file for download on the Xbox.com website.
Available in the sampler is the Airport Terminal map in single-player mode. This is three laps long.
British developer Black Rock was responsible for arcade off-road racer Pure. New game Split/Second, set in the future, follows competitive and life-threatening racing as part of a mega-budget television show.
The key gameplay feature, aside from going really fast, is being able to tear down huge chunks of scenery in spectacular fashion by using charged power-ups.
Split/Second is due out for PC, PS3 and Xbox 360 on 21st May.

Dreamcast gem Jet Set Radio may reappear on Xbox Live Arcade.
The game's logo and name were spotted on the Xbox dashboard by French website Spirit Pixel and picked up by Destructoid.
SEGA has offered Eurogamer "no comment" on whether this is a Dreamcast re-release, a new game or a fake.
Jet Set Radio introduced the world to cel-shaded graphics, while gameplay involved spray-painting Japanese cities and playing music while avoiding police and battering other gangs.

Some mad but brilliant people have managed to keep the Halo 2 dream alive for more than 10 days, despite Microsoft officially ending support for Xbox 1 titles on 15th April.
As detailed on the Bungie forum, a die-hard group of around 20 people simply didn't turn their Xboxes off at zero hour and have been able to continue killing one another while sobbing uncontrollably ever since.
Unfortunately they have started dropping out now due to overheating and net connection problems, but those who remain have vowed not to stop until Microsoft boots them or they die or whatever.
Heroes of men. If they do drop out, of course, they could always read Better Than Halo: The Making of Halo 2, our massive retrospective on the game that arguably made Xbox Live, which is full of details on the game's development direct from the men who worked on it.

Its release is still a long way off, but the hype machine for the next instalment in the Halo series steps up a gear tomorrow with the UK premiere of movie short ‘Birth of a Spartan’.
The 60 second ad will appear following the full time whistle in the Lyon vs Bayern Munich Champions League clash on Sky Sports tomorrow night.
It will also air after the Barcelona vs Inter Milan match on Wednesday April 28th on ITV1 and subsequently across a number of stations including Bravo, FX and Comedy Central.
In addition, it will be available to download from the new Halo: Reach teaser site from 5:00am tomorrow morning. The same site currently carries a message stating that ‘AUGMENTATION BEGINS APRIL 28, 2010’.
April 28th will also see the Xbox Live debut of the full two minutes and thirty seconds version of the movie – the same one that will be run before Iron man 2 in US cinemas.
The film, which is directed by Noam Murro. Depicts the transformation of Carter 259 from an army cadet into the future leader of the Noble team that plays the starring role in Halo Reach.
It’s not the first time that a publisher has targeted the Champions League as the prime spot to promote its title. The likes of Codemasters (Race Driver: GRID), EA (Rock Band) and Activision (Call of Duty: Modern Warfare 2) have all run ads during key matches in the competition in the past, and Sony last year extended its Champions League sponsorship until 2012.

Less exciting news out the way first: Activision has registered a web domain for BloodStoneGame.com - suggesting that rumours of the title for its new James Bond title are true.
Now, time for the big stuff: The firm has also registered a site at GoldenEyeGame.com, hinting that a distant relative to Rare's classic N64 FPS might be on the cards.
That's all we have to go on so far... but it's highly unlikely that Rare will work on any update to the franchise - as its team is now locked away working on Natal titles for Microsoft.
EA released the last GoldenEye game - Rogue Agent - back in 2004, to mixed reviews.
Since then, Activision has taken on the Bond licence - with Bizarre Creations-developed 360, PS3 and Wii title Bloodstone on the cards for an E3 reveal.
Would you like to see an HD remake of the classic N64 version, readers? But perhaps more importantly, would you like to see an HD remake that doesn't involve the original developer?

New Natal shots have hit the net and this time they feature players of all ages with their arm in the air.
The shots show Ricochet again, which we saw Jonathan Ross attempting to play back in February.
We reported on the possibility that Natal's camera has a "tilt motor" inside last week, which suggests that the device might be able to move itself.
With that still yet to be confirmed, however, it's just Ricochet for now. Shots below.

MS will reveal a slim 360 natal bundle at one of their two (yes, two) press conferences at this year's e3.
What's more the 360 will be getting a subtle rebrand, with a new logo and black as the new primary colour of the console. They feel that the new system needs to be black because a white Natal wouldn't sit well next to the typical gloss black tv.
The new system design is pretty neat.
And Natal? Let's just say you'll probably be both very surprised and very pleased by one of the games revealed... what is it?
Might Get Shot if I were to tell.

For those of you thinking that Capcom's recently revealed Marvel vs. Capcom 3 was born from the strong sales of last year's Marvel vs. Capcom 2 downloadable release, well, Capcom's Ryota Niitsuma has some learnin' for you. "We really started working in development in summer 2008. But all the contract and legal negotiations -- that came way before that, as well. So ... we started to produce this game before the success of Marvel vs. Capcom 2 as a downloadable title," Niitsuma told GameTrailers, speaking through a translator during an interview at Captivate 2010 (found after the break).
Notably, Niitsuma's timeline contradicts statements made by Capcom last May. At that time, Capcom's Seth Killian told us, "What we're hoping is that if people get really juiced about [the MvC2 downloadable release], and we can show Marvel that there's a lot of heat behind this, then they'll open up the door for us to do something with '3,' which is something we'd love to do." Boy, the things a company representative will say to guard an early-in-production title.

Sure, Kim Kardashian and Russell Crowe signed airbrushed Xbox 360s bearing their likeness for the David Peachy Foundation's "Konsoles for Kids" charity auction, but Weta Workshop co-founder Richard Taylor built his donation into a badass diorama. That's Halo's Master Chief venting the console with his trusty assault rifle, sending chunks of circuit board, capacitors and LEDs out the other side. According to its eBay seller, the PAL system's still fully functional, and ships with controller, cables and a full warranty. Auction lasts till April 24th; bidding is presently at $810 AUD.

Microsoft has now sold more than 40 million Xbox 360 consoles worldwide according to figures released overnight.
In January Steve Ballmer said the firm had topped 39m, and the platform holder's latest financials reveal an additional 1.5 million were sold during the quarter just ended. Microsoft later confirmed the 40m figure to IGN.
Microsoft's financials also reveal that the console's software attach rate - the number of software units sold per console - is now 8.8, although the investor presentation doesn't say whether that includes digital sales (we expect it does).
Xbox 360 launched in November 2005. PlayStation 3, which launched in November 2006, has sold 33.5 million units worldwide.

Microsoft's Entertainment and Devices division had a less spectacular quarter, with revenues rising just 2 percent year-over-year to $1.67 billion in revenue. The division saw operating income rise from a loss of $41 million in January-March 2009 to $165 million during the same period this year.
The profit was in large part due to a $62 million windfall resulting from foreign currency exchange rates. Microsoft also called out increased revenue from Xbox Live as a factor, as well as a $199 million decrease in the cost of revenue "resulting primarily from lower Xbox 360 console costs." The drop in manufacturing costs for the console will likely further fuel speculation that Microsoft has developed an Xbox 360 Slim, which would require fewer materials to make and cost less to ship.
That said, both Xbox 360 hardware and software revenues were down during the quarter. Microsoft only sold 1.5 million consoles from January to March, down 12 percent from 1.7 million during the same period the year prior.

About Love364, yes I changed the name ;D Currently we have the core, RSP, and audio implemented. Alot of work so far. Now what about video? Well it seems that every video plugin out there either uses OpenGL or DirectX with Fixed Pixel Pipelines which the Xbox360 does not support. Also due to the differences between Fixed Pixel Pipe-lining and HLSL a simple rewrite isn't possible. So with the advice and over look of Zezu I have decided to write my own up to date graphics and RDP part of the emulation instead of hacking around Rice's video code. Not much progress so far, expect I have been able to process and sort out the commands coming from the RSP. Still a lot of work todo. And thus the reason there isn't any screenshots yet.
The general scoop of this is simple massive. Things can easily go wrong with around 20 basic commands and over 1,000 calls a second just for graphics. I easily I have my work cut out, even when I'm spending 10-12 hours a day coding.
Writing my own graphics plugin and RDP code has it's pros, even though this just seems like a major set back.
Pros and Ideas:
* High Anti-aliasing Support
* HLSL per texture scripting
* Shaders, Bloom, and HDR possibilities.
* Texture Scaling via HLSL.
So in general Love364 will hopefully redefine how N64 emulation looks and runs.
Current Emulation Status
Currently we are still running on one CPU core with little to no optimization with everything run minus graphics at around %50 of the N64 speed. I've yet to look into dynrec or inline function calling, but when the time comes there's no reason why we shouldn't be able to easily hit 100% speed on emulation.

Microsoft has defended the Xbox Live Games on Demand version of Halo 3 that went on sale earlier this week.
"When installed to the Xbox 360 hard disk drive, players may experience longer than average mission and map load times, but regardless of where the game is installed, gameplay performance is not affected," a spokesperson told Kotaku.
That tallies with what Digital Foundry discovered following the launch of New Xbox Experience in late 2008, where loading times for Campaign maps were around 10 seconds longer from HDD than DVD on average.
Still, whether you're waiting 46 seconds or 53 to kick off Sierra 117, you know it's going to be worth the wait. Unless you've never played Halo 3 before, in which case you should: it's like a cross between Lord of the Rings, Star Wars and Barney the Dinosaur.
