Tyrone Spellman was found guilty yesterday of third-degree murder for killing his 17-month-old daughter in 2006 after she knocked over his Xbox. The Philadelphia Inquirer reports the jury reached the verdict after eight hours, adding that Spellman faces 23.5 to 47 years in prison. He has three prior drug convictions.
Apparently, after impulsively beating his daughter to death, Spellman propped the dead child by some barbells in order to mask the death as an accident in the eyes of arriving EMTs. In a post-verdict conversation, Prosecutor James Berardinelli was told by the forewoman that the jury believed Spellman acted "in a rage" but didn't mean to kill the child.

Top Microsoft exec Jeff Bell has revealed that the format holder plans to make Xbox 360 ‘this generation’s PS2’.
Bell, corporate VP of global marketing for Microsoft's Interactive Entertainment Business, also said he was hopeful that 360 would become popular with Wii owners who had ‘graduated’ above Nintendo’s console.
Speaking to 1Up about how Microsoft saw 360 in comparison to Nintendo’s Wii, Bell said:
“We very much are positioning ourselves to be the choice console of this generation, much like the PS2 was in the last generation.
"[That's] Great value for money from a price standpoint, all of the games that you want to play, a huge variety of games, and now, not only a DVD, but the ability with Xbox Live to have great community relationships, as well as downloadable television shows and movies - not only here, but around the world.
“We're positioning ourselves to be ready if, in fact, gamers find they're ready to graduate from a certain experience potentially with the Wii, either because it's limited on the type of gameplay that's available or the technology in that box.”

Turning Point developer Spark Unlimited has taken time out of polishing Turning Point: Fall of Liberty to ease our minds that the game might not be up there with COD4.
You can see us playing the demo in question right here, which - as we said - features a few dodgy glitches that we certainly hope will be ironed out before release. The response, via an IGN Blog, reads:
Our Response to Player Feedback on the Turning Point Xbox 360 Demo
We just wanted to take a moment to personally thank everyone who took the time to download the Turning Point: Fall of Liberty demo and to comment on our work in progress. All of your feedback is very valuable to us and we are working hard to meet your expectations with the final version of the game.
Since the demo was finalized, the team has put several months of work into the code and we thought you might like to know that a number of questions raised by those trying the demo will be positively addressed in the final game.
For example:
Optimized targeting and movement: Optional control settings have been refined to alleviate sluggishness in the slowest setting and the 'on ice' feeling at the faster settings. Also, a user-defined soft lock has been added which means that controls can be set so once an enemy is hit with a bullet the crosshair will 'stick' to the target.
Refined AI behavior: The dynamic intelligence and pathfinding for enemies has also been enhanced. The 'hot point' based system should add to Turning Point's replay experience.
Ammo levels and grappling optimized: Up until final submissions, the team has been listening to playtest feedback and doing everything possible to create a 'civilian at war' feeling. The end result is an experience more visceral than the demo, relying less on repeated ammo refills, and more on the grappling and the hand-to-hand combat.
Final Mip-mapping and texture levels: The art team has also been able to further optimize lighting, textures, and effects throughout the title.
Again, thank you for all your feedback and support as we finalize Turning Point: Fall of Liberty and continue to do everything possible to deliver on our goal of creating a fantastic and entertaining experience for you.

Street Fighter IV appears to feature super cancels; a mind boggling procedure where you cancel a special with a super. Makes perfect sense.
Evidence comes from a sequence of screenshots given to Eurogamer which show Ryu slamming his fiery balls into Ken.
Fans should be able to spot the enormous fireball immediately following the initial small burst.
Those who have no idea should concentrate on the facial expressions of Ryu and Ken, the warring would-be brothers who trained at the same dojo once upon a time and were also portrayed as two con artists in the rubbish film.
Street Fighter IV aims to take the series in a new graphical direction. It features chunky 3D models and scenery but good old 2D fighting.
The game is due out on 360 and PS3 sometime in the future, hopefully later this year.

French developer Load Inc. is back for another crack at an Xbox Live Arcade racing game with Things On Wheels, due out in summer 2008 via publisher SouthPeak. Exact pricing has yet to be revealed.
Described as an "accessible, pure arcade racing title", it sees you driving remote-control cars around the rooms of a house with tracks built up of everyday items.
The twist is that routes are more freeform, and it sounds as though there's more scope for carving your own path between objectives, through table legs or past electric heaters. Sort of like Midnight Club meets Micro Machines.
Load Inc.'s last XBLA game, Mad Tracks, divided opinion, but SouthPeak and Load, Inc. are confident that this one will be better, with a source close to the developer indicating there was a bit more filthy gaminglucre behind this one.
SouthPeak has only released one screenshot, for now, but we put it on the internet for you anyway. Enjoy!

Halo 3 has returned to the top of the most played list on Xbox Live for the week ended January 21.
It was pushed off the top spot last week by Activision's Call of Duty 4, the seven million-selling game which has dropped back down to number two.
SNK's Metal Slug 3 is still the most popular Live Arcade title purchased over the service, while Halo 2 is still the number one Original Xbox game.
Terminator: The Sarah Connor Chronicles beats Family Guy, South Park and Naruto as the most downloaded TV show, while Mr. Woodcock tops the movies list.

Atari has rolled a Beautiful Katamari demo on to Live Marketplace.
Yes, the US had it months ago, but they also had the full game from October. Ours is not due to arrive now until March, after it slipped back from February yesterday.
The good news is you can very nearly play Katamari on 360 for the very first time, and it has better graphics and more things on screen and new challenges and online support.
The bad news is it feels more like a high-definition remake than full offering in the widely celebrated series. That which made the PS2 originals so bright and refreshing has remained stagnant here, resulting in being branded as a "fairly poor Katamari game" by our editor Tom.

It looks like we could finally have a release date for Silicon Knights long, long in development action effort Too Human, which has been dated at retail for this May.
US shop GameStop says that the Xbox 360 exclusive is scheduled for a May 6 release in its weekly e-mail update. Perhaps the lawsuit with Epic didn't effect it much after all, then.
The RPG-come-hack-n-slasher is the first part of a planned trilogy from the developer and should be one of the biggest Xbox games of 2008 (provided it's not rubbish, of course). It's been in development since the PSOne days so the story at least should be reasonably fleshed out, we hope.
SK boss Denis Dyack told Kotaku that a "firm date with tons of new info is coming soon" back in August last year. Perhaps this is the real deal then, but we all know how online retailers love to tell porkies...

SouthPeak CEO Melanie Mroz says she isn't worried about slowing sales of Xbox 360 hardware in its second full year on sale.
"The 360 market is hardly at a standstill," Mroz told Eurogamer as SouthPeak unveiled its first title for Xbox Live Arcade, "and there's plenty of potential for both XBLA and traditional retail, so it'll still be are the core of our plans for time being."
Despite the launch of key games like Halo 3 and Mass Effect in 2007, the Microsoft console only rose from 10.4 million sold in January to just under 18m by year-end.
"We prefer to publish games for their own merits, rather than because of the platform that they're on - there's still plenty of titles coming up and plenty of money to be made!" Mroz added.
SouthPeak's chief executive also said that we can expect more Xbox Live Arcade games from the publisher in future, and that further titles for Nintendo WiiWare and PlayStation Network are possible too.
"We certainly have things in the pipeline, though we can't talk about them just yet. However, rest assured that we'll be announcing further plans for XBLA very shortly," Mroz explained.
"This is something we're certainly considering, as all three online platforms offer a similar scope to Xbox Live Arcade for the kind of titles we like to publish," Mroz said, when asked whether we might also see SouthPeak titles on WiiWare or PSN.
"It would also be great for us to publish titles on every current format - online platforms included. However right now, XBLA is the most established so it'll be our focus for the time being."
If things go well with Things On Wheels though - and Mroz argues that it's "an AAA title" - it could lead the way. "We'd certainly love to put it out on PC or PSN in the future," she says, "but we've got no concrete plans yet - the team is focused on the XBLA version at the moment."

EB Games has crushed rumours that the retailer is "at war" with Microsoft over AUD 10 million worth of defective home consoles, calling reports "99 per cent bulls**t".
A report on gaming blog Kotaku supposedly from a source within EB Games Australia stated that the company had been left with AUD 10 million worth of Xbox 360's after taking them on behalf of customers looking to return faulty units to Microsoft.
It then suggested that Microsoft had refused to take the stock from EB Games, and also noted that a shortage of Premium Xbox 360's available from the retailer was also evidence that there were serious issues between the two companies.
But EB Games chief executive Steve Wilson has crushed the rumour by telling The Sydney Morning Herald, "It's 99 per cent bullshit really."
A lack of Premium units was simply due to strong demand over the Christmas period said Wilson, with consoles from other manufacturers also in short supply.
"If you go into our stores now you can't buy a Wii, you can't buy a DS, you can't buy a Pro 360, but you can buy an Elite or an Arcade 360," he said.
He suggested that AUD 10 million was an absurd figure, and even when there had been problems with a particular batch of Xbox 360 stock due to the well publicised 'red rings of death' issue, numbers were still relatively low.
"Even when we had the batch problem six months ago, we were talking about a couple of thousand units."
"AUD 10 million is 25,000 units – that's a ridiculous number," he said.

Tom Clancy has released a new downloadable content package for Ghost Recon Advanced Warfighter 2 on Xbox Live.
The Co-op Collection, as it's titled, features an all-new co-op campaign comprised of five missions, and nine maps. Seven of those have been "inspired by classic maps from Ghost Recon's illustrious history", while the other two have never been seen before. There are nine new Achievements to unlock, worth a total of 125 points.
The new campaign is set on the border of El Salvador and Honduras, where a rebel leader is attempting to destabilise the governments of both countries and overthrow their US-backed leaders. Because, of course, the US has an excellent record of picking tip-top blokes to run South American countries. Anyway, the Ghosts are being sent in to stop the uprising and, "If they fail, America's efforts in the region could be set back by decades."

The Xbox 360 versions of Phantasy Star Universe and Ambition of the Illuminus will be updated to version 2.0001 during the February 1st maintenance period. This title update will address some issues in the game, such as the Photon Gacha text bug and machine gun glitch.
Sega would like to remind players to log out of their gamertags and restart their Xbox 360 consoles after receiving the update in order for it to function properly.

Of course you do. Straight out of EA, here's three minutes of delicious gameplay from Tiberium, the FPS take on the Command and Conquer series, for you to peruse. We had hoped the most prominent visual feature would be a massive, god-like player ever present in the sky, cutting a swath across the battlefield with his gigantic, scythe-like pointer, the deafening sound of clicks echoing above the gunfire. We were, as you can see, disappointed.
The footage here looks pretty good though, despite the fact that the size of the gun and the rocking motion gives the illusion that that player is riding in a large, well-armed canoe. What do you you think?

Over the weekend, a Kotaku AU reader sent through a chat log containing an enlightening conversation with "an associate of mine who holds a high position within the EB organisation". According to the log, Microsoft is refusing to take responsibility for its defective consoles, leaving it up to the games retailer to make the best of a crappy situation.
Obviously we're trying to verify the facts, but for now, there's no reason not to let you guys know of the potentially nasty relationship that may exist between EB Australia and Microsoft.
According to the transcript, EB Australia has $10 million worth of defective Xbox 360s gathering dust, as Microsoft is unwilling to take them back. As a result, EB is no longer stocking the 360, except as second-hand or pre-owned units. A search of the EB Games website for "xbox 360" confirms this.

Perfect Dark Zero is one of my favourite games on the Xbox 360, before coming to the Xbox 360 though, the game had some time on the Gamecube, and Original Xbox. A few days ago some footage of the game's and early build stages on the original Xbox have been released, I hope some actual game play footage exists with the final graphics and all, if the game was ever that far into development. For those who have played PDZ, you might see a few similarities in terms of map designs between the 2 builds.
Note: Their is no way anyone can say that these graphics would have been the ones you would see in the final build if it were to be released on the Xbox.

Undertow developer Chair Entertainment has signed the rights to create titles based on author Orson Scott Card's Ender's Game sci-fi series.
The developer is targeting all current home and handheld platforms as well as PC, with the first title due for digital release.
"I have been a huge fan of Ender's Game since I was ten years old, so it is a true honour for our team to be entrusted with creating the first video game inspired by this classic story," commented Donald Mustard, creative director of Chair Entertainment.
"Our goal is to create an authentic Ender’s Game experience that delivers awesome gameplay and can be enjoyed by both long-time fans and gamers new to the series."
Chair and Orson Scott Card have previously worked on the game Empire, with the author creating a novel to accompany the release of the game in 2006.
"From the moment I started working with Donald Mustard and his team at Chair, I knew that these were the guys I wanted to do the first Ender's Game videogame," said Orson Scott Card.
"It's not enough to slap the Ender's Game name on just any game – it has to be exciting, memorable, and endlessly replayable. Chair shares my understanding of this and I am looking forward to working with them to ensure the game is as authentically Enderish as possible."

Ubisoft has pushed the release of Dark Messiah of Might & Magic Elements back one week to 15th February.
The latest release schedule for the publisher also shows delays for Assassin's Creed on PC and DS, which will now both be available on 28th March. The former was originally due on 1st March, while the latter was supposed to be out in February.
Meanwhile Haze PS3 and Brothers in Arms: Road to Hill 30 (Wii) have been slotted into the murky waters of Q1 - between April and June, in other words.
Earlier this year Ubisoft revealed it would push a handful of key titles into the latter half of 2008, including Far Cry 2, Tom Clancy's EndWar and Brothers In Arms: Hell's Highway.

Xbox Live Arcade will be athumping and achin-stroking this Wednesday as Xbox Live fans tuck into Rez HD and Chessmaster Live from 9am GMT. That's 30th January, in case you're dozing.
As usual, both games will be flanked by trial versions, both come with 12 unlockable Achievements for a total of 200 Gamerpoints, and helpfully for this particular sentence both will set you back 800 Microsoft Points (GBP 6.80 / EUR 9.60).
Rez HD is the one we know more about, not least because it's a sharpened-up port of a Dreamcast and PS2 rail shooter that many of us rather liked.
As you will know from our giddy first impressions of the Xbox Live Arcade redux, the original jaggedy version is included alongside a new high-definition version which looks so sharp you could stick an 'e' on the end of its name and use it to tell Napoleonic War stories about a self-made man.
As for Chessmaster Live, we're interested in seeing whether it succeeds where Wii Chess failed in letting us compile our own Eurogamer Chess Team, although since we wrote about its Nintendo competition we have rejigged the line-up in our dream chess team so that Rupert is king all hail Rupert and despair.
Look out for reviews of both in the near future.
