Following a class action lawsuit against Microsoft regarding 'bricked' Xbox 360s - caused by the fall dashboard update - one of the lawyers involved in the case has said Microsoft's only defence would be "we're Microsoft, and we can do anything we want".
Speaking to CVG brothers in arms Next-Gen.biz, Brian Kabateck, senior partner at Kabateck Brown Kellner said "I don't know what [Microsoft's] defence possibly could be. They screwed up, and there's no question that this [update problem] happened. How many people it happened to, we don't know, but my firm has been contacted by almost 400 people since this became public."
The October 31 360 update caused problems for more than a few gamers, and a huge 76-page complaint thread can still be found on the Xbox.com forum. Many victims of the 'bricking' bug have contacted Microsoft, only to be told they will have to pay for the 360 repairs themselves.
Some onlookers have criticised the legal action as lacking evidence, though according to Kabteck a blog post referring to the problem by Microsoft's own Harry 'Major Nelson' Hyrb could be used as evidence; "[Those posts] are an admission of the problem. ... They acknowledged this problem. [Microsoft] may have excuses for this, but they acknowledged this problem.
Luckily for us, our Xbox 360s are still working fine.
Microsoft is yet to respond to the lawsuit.

Funcom announced that 'Age of Conan' has been approved by Microsoft for the Xbox 360. The announcement means that Funcom can start official development of an Xbox 360 version of the game.
"This is a groundbreaking leap forward for Funcom. The fact that we now get the chance to develop 'Age of Conan' for the Xbox 360 means access to a potentially whole new and large MMO market," said Trond Arne Aas, CEO of Funcom. "The fast-paced and innovative combat system in 'Age of Conan' will suit the demanding console audience perfect. We believe the amazing online capabilities of Xbox 360 will be a great match for MMOs like 'Age of Conan', and as one of a handful officially approved MMO games for the console we aim to create a unique, brutal and powerful online gaming experience."
The Windows version of 'Age of Conan: Hyborian Adventures' is a Showcase title for Windows Vista, and the game won 'Best MMO of E3' awards from IGN, GameSpot, GameSpy and Yahoo. The game was a runner-up to the 'Most Innovative Game of Show' E3 award from Gamespot, and PC Gamer US named it as one of their top 10 most anticipated PC games.
There is no release date for the xbox 360 version but PC version is expected in spring 2007.

Rob Enderle the Principal Analyst in the Enderle Group, has posted an article at tomshardware.co.uk, about the HD DVD/Blue-ray war:
Much like it is with game systems; competing formats for video are not about the best technology. They are about the most prevalent technology. It is expensive to publish movies and, at least for now, you can't put Blu-ray and HD DVD disks into the same box.
With the Xbox 360 moving so strongly into the market and the top accessory this year being the $200 HD-DVD drive the battle may be over by year end. There is every chance that there may be as many as ten times more HD DVD players than Blu-ray players in the market by the end of the year - even if you don't factor in that HP, the current leader in PC sales, started shipping desktop computers with a $100 HD DVD option. This, coupled with a much lower overall cost for the stand alone players as well as better support for legacy TVs and dual mode disks (that have both legacy DVD and HD-DVD content on a single disk), suggests that HD-DVD is now the format to beat.
HD-DVD wins because of the Xbox 360 - which is ironic, given Blu-ray should have won because of the Playstation 3. Instead, Blu-ray has delayed the Playstation 3 to a point where Sony may have to wait until the Playstation 4 to recover.
BetaMax, Mini-Disk, MemoryStick, and now Blu-ray. At least Sony is consistent. Also, if there is one company that is really looking forward to a better 2007 more than Sony I don't know of it. Boy, when you couple in root kits and battery/camera recalls, you are talking about a really nasty run of bad luck for Sony this year.

Winning Eleven X once again features the graphical and gameplay tweaks that enable each new title to play completely differently from previous incarnations. The shooting system has been the subject of extensive retouching, now enabling players to pull off much more accurate snap shots as well as being able to exert a much larger feeling of control when going for quick half volleys or difficult full volleys.
The intelligence of players has seen a marked improvement. For example, players now make more realistic runs into space, often pointing where they would like the ball played. The physical aspect has also been beefed up, with strikers using their sheer presence to turn defenders and likewise, the defenders stepping a yard away to enable them to force players away from goal and not letting them spin into dangerous positions.
Winning Eleven X also has a number of new teams licensed for inclusion, with the International roster now featuring the official kits for Argentina, the Netherlands, Italy, Spain and Sweden. New gameplay modes have been added and features like the much loved Master League mode also returns, together with a host of new tricks, feints and animations that can be used to bamboozle your opposition.

Microsoft has announced the "Xbox Live Arcade Challenge", set to run between 17th and 30th December, which will see players competing in Lumines Live! and Small Arms for big-screen televisions, Xbox hardware and other prizes.
The Lumines Live! challenge will run from 17th to 23rd December and see players competing in the Time Attack 60-second mode, with the top 105 people on the leaderboard as of 12:01am GMT on 24th December. Perfect Christmas present!
Small Arms will also produce 105 winners based on ranked match activity between 24th and 30th December, with the leaderboards reset beforehand. A minute past midnight on the 31st, the winners for that will be drawn. Happy New Year!
They're not bad prizes, either, with a 42" Hitatchi UltraVision Plasma TV for the overall winner of each tournament, and four runners-up getting bundles of HD-DVD player, wireless steering wheel and wireless headset. The 100 after that, in each case, will get 500 Microsoft points.
In order to take part, it looks like you'll have to pre-register over at Xboxlivetournament.com, which doesn't appear to be quite ready to accept your sign-up at the time of writing - but don't worry, you can always read the US rules and FAQ in the meantime.
And doubly don't worry, because Microsoft UK assures us that it will be open to European gamers as well.

Blue Dragon is Microsoft's attempt to truly break into the Japanese console market. The Blue Dragon launch can be billed the REAL Xbox 360 launch day in Japan; at least, Microsoft hopes it is.
According to a confusing machine translation from GameSpot China, the Xbox 360 sold either 27,000 or 70,000 units to accommodate the release of Blue Dragon. If 70,000 is the correct number, an additional 43,000 units of Blue Dragon sold (which is the bulk of the Japanese owners who previously purchased an Xbox 360). In either case, this is certainly a nice boost for Microsoft.
If the 70,000 is the correct version of the translation, it would certainly be odd to see the Xbox 360 sitting at a solid #3 on Japan's weekly sales chart. Microsoft hopes to sell 200,000 copies of Blue Dragon in Japan, which means Microsoft hopes to have around 200,000 Xbox 360 units in Japanese households. While not impressive from the standpoint of, say, the DS -- Nintendo sells that many in two weeks -- Microsoft should enjoy the sales boost and the publicity that goes along with it.

India is fast becoming a key source of labor for American tech companies, but with average annual income in the country less than the price of a personal computer, the hi-tech products manufactured by multinationals that have set up shop there remain out of reach for most of the nation.
That reality became more apparent when a major Indian bank last week launched the kind of financing program that in America is ordinarily used for automobile or major appliance purchases. In this case, however, it's for Indians wanting to buy Microsoft's Xbox 360.
India's ICICI bank says it will secure an Xbox 360 Core system for customers for an upfront payment of the rupee equivalent of about $20.00 and six monthly installments of about $73.00. The Xbox 360 Core system ordinarily sells in India for about $518.00.
With average annual income at less than $500 in India, the purchase of an Xbox 360 would for the typical resident represent a financial outlay that in the West would be the equivalent of buying a house. It's not likely that too many Indians are going to shell out a year's salary just to play Yuvraj Singh International Cricket 2007, a title produced for the local market by Codemasters, even on the installment plan.
Still, the wages paid by Microsoft and other U.S. tech firms operating in India far exceed the national average, even if they're modest by American standards. A programmer working at a Microsoft office in Bangalore is likely making close to $10,000 annually or more. So the company should have little trouble identifying its target customers in the country -- they're likely on its payroll, or that of a competitor.

Operating out of a Newark home cluttered with DVD burners, computer towers and piles of blank discs, Derek Ramirez was like countless other high-tech thieves pirating computer game software, authorities say.
But, those authorities say, Ramirez was a thief with a difference. He would not only sell customers pirated DVDs for Microsoft's Xbox 360 game. For $60, he would modify an Xbox console so it would not reject counterfeit software, they said.
Investigators estimate Ramirez, who advertised on the Internet, had thousands of customers before the Essex County Prosecutor's Office raided his home and arrested him yesterday.
"He was one of our higher profile targets in the area," said Robert Hunter, manager of intellectual property enforcement for the Entertainment Software Association, whose investigators keyed in on Ramirez.
Ramirez, 24, was arrested in the three-story home on Mount Prospect Avenue he shared with his mother and other family members. He was charged with violating New Jersey's anti-piracy act, a third-degree offense that can carry up to five years in prison.

Microsoft's Xbox 360 has enjoyed success in North America, Australia and the UK, but Japan remains elusive. Despite offering exclusive games from Japanese developers and multiple 360 pack-in bonuses, the new Xbox console is having difficulty gaining traction in the Land of the Rising Sun.
According to a Famitsu Marketing data survey, 113,000 Xbox 360 units have been sold in Japan this year. Over the past 11 months, Sony has sold 1.4 million PS2s. The new releases of PS3 and Wii have already trumped Xbox 360 yearly sales in just a handful of weeks. Even the Game Boy Micro, a niche collectible, managed to sell 150,000 units this year. To be fair, Xbox 360 outsold GameCube in 2006 as Nintendo's now-defunct console sold under 100,000 units.
Microsoft is hopeful that the newly-released RPG from Mistwalker Studio, Blue Dragon, can spark renewed interest in the 360 in Japan.

In stark contrast to Wednesday's news that mod chips were to be formally legalized in Australia, British trade organization ELSPA has announced that a man in England has been sentenced to one hundred and twenty hours community service for running a "while you wait" modding service.
The conviction was made at Carlisle Crown Court on the Scottish border, where Stephen Fitzgerald pleaded guilty to nine charges relating to "chipping" games consoles, contrary to the British Copyright Designs and Patents Act 1988 (copyright circumvention offenses). He was ordered to pay £2,500 towards prosecution costs and subject of a Proceeds of Crime Act (2002) confiscation order for £2,710, to be paid by May 23rd or face three months in jail.
Fitzgerald was picked up by Police, Cumbria Trading Standards and an ELSPA investigator in April 2004 when, trading as www.mods-and-sods.co.uk, he operated a stall at a computer fair held at the Swallow Hilltop Hotel in Carlisle, where he offered to modify PlayStation and Xbox consoles while people waited. His stall also offered and advertised for sale pre-chipped PlayStation 2 and Xbox consoles.

The death knell has tolled for Xbox 360's predecessor as official release schedules show seven of the UK’s top ten publishers appear to have turned their backs on the format.
According to official release schedules, major third parties like Ubisoft, Sega, Midway, Vivendi and Activision have no planned future Xbox releases.
European president of Sega Mike Hayes told MCV: “Sales on Xbox have fallen dramatically in the last six months. It no longer represents a viable platform for us.”
And general manager for Activision in the UK and Ireland Andrew Brown added to the groundswell of opinion: “Given the current dynamic in the Xbox market in the UK, we have had to manage the availability of our slate in line with consumer demand.”
According to ELSPA statistics, Xbox enjoyed just 2.6 per cent of total software sales last week. This was still 30 per cent better than the week before, however – perhaps an indication that retailers have started slashing software prices in order to shift remaining stock.
Retailers such as Virgin Megastores, HMV and Woolworths have pulled Xbox hardware off the shelves completely and started selling-off marked-down software.
“It's fairly self-evident that demand for particular titles on Xbox is diminishing and becoming less commercially viable,” head of games at HMV Tim Ellis told MCV. “I can understand why some titles may no longer be coming out."
The only big budget games still officially due for the format are: Avatar The Last Airbender from THQ (09/02), Medal Of Honor: Heroes from EA (Q1 2007) and 2K Games’ film tie-in Ghost Rider (Q1 2007).
