Second class action lawsuit filed against Microsoft

A second class action lawsuit has been filed in a California court against Microsoft, alleging that the Xbox 360 console damages game disks.
Last week, a similar complaint was filed in the state of Florida.

The new complaint, filed by California residents Christine Moskowitz and Dan Wood, seeks at least USD 5 million in damages for all Xbox 360 owners affected by the alleged product defect. The pair alleges that the console damaged their game disks, and that Microsoft refused to replace or pay for the damaged games.

Microsoft recently acknowledged a hardware defect with the Xbox 360 and extended the warranty period by three years. However, the company did not acknowledge that their consoles were scratching game disks and rendering them unusable.

Attempts to reach Microsoft for comment were unsuccessful. However, a Microsoft spokesman responding to the Florida suit told InformationWeek that the company has not received a significant number of complaints about scratched discs.
